  • Has anyone applied for DL in Texas? Need help

    I just went to DPS to apply for the DL however they wouldn't accept my application. I have showed them the rules which stats pending status of I-485 has right to apply. The refused to apply my form of ID which is my valid passport. I am so upset!
    Marriage-based AOS - Concurrent filing.
    03/27-2018 AOS package sent to Chicago Lockbox.
    03/30- confirmation of delivery to USCIS.
    04/11- Four Email/Text notifications
    04/11- cheques cashed
    04/27- Biometrics appointment received.
    04/27-Courtesy Letter-I-693
    05/02- Biometrics walk-in
    08/01- I-765 New Card being produced
    08/03- We approved your case; I-765 & I-131
    08/08-Combo Card received

    No that wouldn't work. Idk what state you're in but in Georgia you need a social security number to apply for driver's license. On the website they list EAD as one. I guess what you needed is not just a government ID but a USA government issued ID. Wait until u get your EAD then apply. A pending i485 applicant with a SSN and proof of permission status (which can be the EAD) can apply. You going into the DMV with your foreign passport and i797 won't get you a DL.

      I have my SSN and here it clearly states that on a pending status of I-485 can apply for DL

      applying to become lawful
      permanent residents.

      Immigration documentation with an alien number or I-94 number
      This can include but is not limited to a form I-797 indicating pending I-485 or
      pending application for adjustment of status.

        I believe what they are referring in the document is i-797. What you have i believe is i-797c which is widely used and issued to communicate receipt of payments, rejection of applications, transfer of files, fingerprint biometric, interview and re-scheduled appointments, and re-open cases.

          It says "indicating pending I-485 or pending application for adjustment of status", so it is clearly not referring to an I-797 approval notice.

            Some DMV offices don't give DL to non residents even though it's on their website. One user on here was in the same situation as you with her husband. She said when they entered his information into the system it wasn't approved because they were getting like a red flag message. She said she traveled to another DMV office where he was issued his permit and eventually his license. So if I were you take all of your documents along with a print out from from the website when u get your EAD. Some places don't accept foreign passports as ID. Some places I've sent applications to photocopy my Visa page instead of my passport biographic page. Because of the political climate at hand I think some places aren't accepting certain documents like before. Good luck!

              Seems like I misinterpreted the notice I had so much hope to finally be able to drive... It feels overwhelming to wait 3-5 months for EAD..

                Why do you think you misinterpreted it? I agree that you should be able to get a driver's license based on what they said there.

                  Not sure if this will help or not but just wanted to pass

                  Did you ask them to do 2nd stage verification ? I had the situation where my H1 extension was pending and driver license got expired. I went to DMV office with 797c receipt notice and they said no. I asked my lawyer and she suggested to ask them for 2nd stage verification. It worked. DMV officer had no issue with going for 2nd stage verification. It takes few weeks and then you will receive the letter which tells if you are good to go or not.

                    Thank you so much for the info. It definitely does help! It feels like worthy to try one more time to see if they process the application.
