  • AOS interview Cleveland - affidavit question

    Hey peeps! I am brand spanking new to the forum but I have been visiting this site for the past few months as I try to navigate this I-485/I-130 process. This site has been so helpful! I am a US citizen recently married to a Jamaican who was here on an H2B. He went into to over-stay status in November 2017. I met him in December 2017. And we married in February 2018. Things went super quick but I have not for one second had any regrets. Anywho, we submitted our combined I-485 and I-130 packet on 2/26/18. We ALREADY have our interview coming up next Monday (5/21). Super quick, right? When we submitted our packet in February, I stupidly turned in all original affidavits (DOH! *face palm*). We had 12 of them! And I made no copies (Double DOH!). My question is will the IO that is conducting the interview have copies of those affidavits? In preparation for our interview I have been doing mad research and every website say to bring affidavits. But why if I already turned them in? I REALLY don't want to have to go around and get all new affidavits. Please advise. Also, any tips to help us through our interview would help! I am nervous! We have lots of evidence to show but I know our time-line looks kinda shady since things moved so quickly for us.

    For other fellow Clevelanders wanting time-line info, here is our journey thus far:

    Packet mailed out to Chicago- 2/26/18
    Packet rcvd- 2/28/18
    Biometrics appt- 3/27/18
    Interview notice rcvd- 4/21/18
    Interview date- 5/21/18
    Marriage-based AOS - Concurrent filing. (Cleveland)
    2/26/18- Sent out packet
    2/28/18 - Application rcvd
    3/16/18 - Biometrics appt. Notice 3/27/18.
    3/27/18 - Biometrics appt attended
    4/18/18 - "Case is ready to be scheduled for interview"
    4/21/18- Interview notice rcvd- scheduled for 5/21/18
    5/21/18- Interview took place
    6/22/18- Approval rcvd for I-485 (via text and email)
    6/26/18- Approval rcvd for I-130 (via text and email)

    I didn't see a problem if you submit the original affidavits. But why 12 affidavits????

    Normally 2-3 is enough.

      Wow. Yes your timeline will indeed be questionable to the immigration officer but who knows. Different case for everyone.

      Just work on knowing each other in detail. Yes you would need to have the affidavits with you just Incase the interviewing officer doesn?t have them. They lose documents all the time. It?s best to be prepared if you think they will help your case.

        A lawyer we consulted with said we should get as many as possible because he is out of status.....plus lots of folks from both sides were offering so we accepted them :-)

              I will, most definitely. Out interview is 5/21 at 8:45 a.m. Eeeeek! This forum has helped us so much....I feel like I owe it to y'all LOL. In the beginning we were thinking about getting an immigration attorney and instead decided to do all the research and paperwork ourselves. So far, so good!

                  So the interviewer asked pretty basic questions at first.....mom and dads names, kids names, how we met, who proposed, dogs name, what sports my kid plays, what instruments he plays, what we do for fun, where did we get married. Then he got a lil more "nitty gritty" and asked about my previous marriage and how long we were separated for last year. My divorce date and new marriage date are close together so he had reason to be skeptical. We did NOT get an answer at the end of the interview so now we wait....he said he will have his determination by the end of the day so I will be stalking the USCIS website til it's posted. We just got married in February so no matter what it would be a conditional visa so I am really hoping that because we gave him lots of evidence that he gives us a chance.

                      We arrived at 8:15. Our appointment was at 8:45. We got called back around 8:55. I think it lasted around 50 minutes total. The first chunk of time was the interviewer going over the I-485 with my husband and the I-130 with me. The personal questions took up maybe 15-20 minutes of the interview. Through out the interview he took notes. We brought a binder full of evidence for him to look over...he did so but briefly and then handed it back to us. I REALLY hope we get an answer today but I know that is probably pretty hopeful. But who knows....

                          Congratulations on getting through the interview! It's only natural to be nervous about the timeline, but you just have to own it. You are a US citizen, you pay your taxes, and have every right to marry anyone the day right after your divorce is finalized.
                          Don't let people corner you into shame. If your whole neighborhood is doing it, well, you're in the wrong neighborhood, then.

                          My divorce finalized a few days after I met my spouse in June 2016. We married August 2017. It looks like a "short engagement" but really, I had been separated from my previous spouse for several years now and can prove it. My former spouse has agreed to give me an affidavit, too.


                          As long as you provided a reasonable explanation for everything, you will be fine. As I keep telling my spouse, if they need to show up at our door, awesome. They'll find the two of us here. It sounds like that is the case with you, as well.

                            Thank you for your kind/reassuring words. I think sometimes its easy for this process to make you feel like you're doing something wrong....having to justify your marriage to a stranger just feels very icky. During the interview I was calm, cool, collected and gave the interviewer good answers for all his questions. My ex husband and I were separated much of 2017 and I had previously filed for divorce with him 2 other times....I explained all that to the guy. Hopefully he believed me. My husband was pretty nervous and it kinda showed but the interviewer recognized this and told him to take some deep breaths. I am hoping we find out soon what the verdict is....the waiting game is torture!

                              Yes it can be stressful but let?s pray everything goes well for everybody.

                              I met a guy from Africa who got married to a 53 year old US citizen. He is 33. Their interview lasted 25 minutes but he told me he didn?t get his green card until after almost a year. Not sure if they gave him the 10 year one or conditiobal one. I guess they were suspicious of the age gap that?s why it took too long or maybe delays in background check.
