went to infopass appointment ... they say there is nothing!!

  • went to infopass appointment ... they say there is nothing!!

    Yesterday i attend an infopass appointment at Harlingen Tx. just to ask if i can travel to Dallas (i live near the border), they say that i can't, but anyway, here is the thing, he look my case status and he said "there is nothing" you still don't have any approval yet, not even in review!!! this may 22 is going to be 120 days since i start my process (C9 by the way), Can someone tell me please if this common? Also, in the web page it pops a something like :

    Validation Error(s)
    You must correct the following error(s) before proceeding:
    User-Defined Error

    this error is being there since last month and it hasn't change at all,


    My time line:

    PD: 1/22/18
    biometrics letter :02/02/18
    Courtesy letter: 02/16/18 : the version i-693 is no longer in use....etc etc, if you receive an interview notice you must bring it with you...etc etc,
    biometrics taken: 02/22/18
    SR (I-765): 05/10/2018: and... nothing!

    I read you every day, please tell me, is this normal?? To be in limbo?? my case isn't designated yet!! 120 days!!! and nothing!! Why!!??

    Just be patient as we all are in this forum. You cant do anything else just wait.

      You mean you have filed I-485 but have not received an I-485 receipt?

          I think I saw somewhere TX is very slow So....be patient! You can check the processing time to see how long will it take in your field office.

            Hello,

            the wait you are experiencing is normal, dont be discouraged by what you read about others moving along when you are not, remember every case is different and the field offices processing times play a major role in this, if you go to this link: https://egov.uscis.gov/processing-times/#mainContent select I-485 and the Harlingen, TX as your field office you will see that the processing times for family based applications like yours are taking from 12 to 23 months to be processed. This means 50% of the cases (usually cases without RFEs) are processed within the first 12 months after your application, you can also find information about how to understand this processing times in this link: https://egov.uscis.gov/processing-times/more-info

            Have you created an account at the USCIS website to review your status?

            EAD (765) have been taking longer than 120 days, based on what we have been reading in this forum. If you have a job offer you can request to expedite this (however, it is not guaranteed that it will get expedited)

            The uncertainty and wait are very difficult to handdle, more than one of us in this forum understand your frustration, however, sending a lot of SR, info pass doesn't seem to change anything or help in anyway, specially when your case is still under normal processing times, like yours.

            Stay strong, read through the posts on this forum a little further, I hope it helps you ease the pain and understand the process better as it has done for me.

              If you have your I-485 receipt, I don't see any reason why you can't travel to Dallas or anywhere else in the US.

                You?re right. All we can do is waiting. I requested expidite and inquiry but they keep saying my case is in normal processing time. So i give up on those requests. It doesn?t help. We just need to wait.

                  I am confused. I do not understand why you would get an Infopass appointment to ask if you could travel to Dallas. Please clarify.

                  Pretty much everyone who gets that user defined error for 3 to 4 weeks ends up with an interview notice soon after that. It's what we've observed in the forum.

                    i think it is because there is a check point where you have to prove lawful status

                        Like Check Point Charlie in East/West Berlin. I guess I learned something new. If you're in a city in TX and want to drive to Dallas, I don't see how a receipt is needed. But again, had no idea.

                          Yes, there is a check point between mi city and dallas, and yes, they check your visa the same as at the border, so that's why i can't travel to dallas or any other state, because i don't have any status yet.

                          I taught the same, but have my doubts, that's why i went to ask an officer about it and he said "Noup" , you may get deported all the way to mexico, so i will not risk it.

                            That is complete misinformation. Whoever you talked to doesn't know what he's talking about. Furthermore, the checkpoints are run by CBP and not by USCIS. Deportations are done by ICE and not USCIS. So you should not be asking USCIS about any of this; they have no idea.

                            What matters at the checkpoint is whether you are deportable. If they do not deport you, they will let you go. They do not deport people with I-485 pending just for being out of status (and I-485 can be filed in deportation proceedings anyway, so you will not be deported no matter what, assuming you were eligible for I-485). Your I-485 receipt proves that you had an I-485 filed. They could put you in secondary to verify that your I-485 is still pending, but once they verify it, they will let you go.

                              Sorry, but you're wrong according to CBP, USCIS, my attorney, and my contacts at an Rio Grande Valley area airport. If you pass the checkpoint without a valid status, you will be detained and possibly transferred to the detention center for processing. Now sure, your attorney could probably get you out, but who wants to deal with that hassle?
