I-30 not approved after interview / Long case

  • I-30 not approved after interview / Long case

    Good morning everyone! I have 2 questions actually, here they are:

    1. I went to my interview and it wasn't approved because I had an open case (which I thought it was closed) in some other office and the officer said that he needed that file in order to approve me. That was back in 2012!! My I-30 petition was not approved (it says pending still). Is that normal?

    2. As I mentioned above, my case has been lingering since 2011!! In November will be 7 years. Can I file a complaint with immigration for taking so long to make a decision and receive my GC without going to a second interview?

    I meant to say I-130.
    You stated in another thread that you were divorced. Your i-130 can NOT be approved if you are now divorced.

      Yes, I know, but at the time I was not divorced, and I was married for 3 years and a half. In these 3 years and a half, after the interview, how come at least the I-130 wasn't approved? That is my question.

        USCIS moves at its own pace. Their reasons for not approving you in the last 3.5 years do not matter. What matters is the status of the petition on the day you get approved/denied. Since you are now divorced, you have lost the basis of the i-130 filed for you and it cant be approved no matter what. What you need to focus on is a way forward. Lingering on a petition with a foregone conclusion will not get you anywhere near the desired outcome.
