  • I-485 interview scheduled - worried about evidence

    I?m sponsoring my wife for her visa and we recently got an interview date. However I?m worried about whether we have enough evidence to present. Our current status is:

    1. We married April 2017 and filed June 2017.
    2. We have wedding photos, marriage certificate, etc. as well as people that would vouch that we are, in fact, a real couple.
    3. We live in a condo that I bought back in 2008. The mortgage is in my name. So we don?t have any lease, etc. that has her name on it.
    4. We have a joint checking account, but it?s not the primary account for either of us. We maintain mostly separate finances. Things like mortgage, etc. is paid out of my personal account.
    5. My car is nearly 20 years old and fully paid off. My wife does not drive, so there is nothing car related (insurance, etc.) in her name.
    6. We have a family cell phone plan. However I added her before we actually married, so the account is under my name only.
    7. She is listed as the beneficiary of my company?s provided life insurance.
    8. She?s listed under my company provided health insurance.
    9. We filed our 2017 tax returns jointly, so her name is on there.
    10. She?s added as an authorized user on my credit card account.

    Should I be worried? #4 is really the big one I?m concerned about.

      I?m not sure the reason why you have separate finances but if you have a solid reason the immigration officer would understand. I haven?t gotten the interview yet but me and my husband have a joint account but we maintain separate finances because I have a son and he he has two kids from his previous marriage that he he is paying back child support for. So we decided that we are only going to contribute to the joint account money for bills only and keep separate accounts so he can have his monthly child support deducted from his account. His paycheck goes to his account. That?s the explanation that we will give to the officer.

      Have you thought of getting a sam?s or Costco membershipship for both of you. Or an AARP membership?

        I would suggest spending some time going through the links on that thread that xnot directed you to. There are 1001 ways to show that someone lives with you. It's not just about having a joint mortgage or lease. We installed a smart lock on our front and back door for security, and to have a log of who goes in and out. If you couple that with our iphone location history, then you have a smart lock log that shows the times when either one of us opens and closes the door with the phone, along with the location history. If you have video surveillance -super cheap-, you can take screenshots of the videos late at night when you are both sleeping or on the couch.
        Something that caught my attention is that your list does not mention anything about your relationship before you got married. If you file for AOS shortly after getting married, I always suggest handling the evidence the k-1 way. What is that way - you might ask. Well, I recommend that you document the progression of your relationship from the time you met and started dating until the present day.

        About #4. Is that condo the only property you own?

        It's not just about showing that your spouse is listed as your beneficiary on your life insurance, health insurance etc. You should be prepared to show how long she's been on there.
        USCIS expects joint finances. That's how they defined evidence of bona fide marriage. If you deviate from that, then be prepared to be scrutinized more. Do not wait to be asked. Just come out and say "we do not commingle because X Y Z" Or we deposit this much into the joint checking to take care of joint bills.
        I had my 2016 and 2017 tax returns deposited into my spouse's personal checking account. Both were substantial returns. Enough to make a stranger wanna empty the account and run. I did that just to show that I have no issue with it. I am not even an authorized user on that account LOL - now that I think of it.
        'So maybe you could deposit the mortgage payment into the joint checking account and then have her write the check?

        There are a lot more things you could do. The most basic one - the target red debit card is missing. You link it to the joint checking account and buy laundry detergent when you drive by target, You each get a card on your name and get online access.
