  • Can i go travel outside the US while I-485 is pending?

    Dear All,

    I just got Employment Authorization Document (EAD) advance parole documents approved.
    My i-485 is still pending. I want to travel back to my home country.
    Can i go travel outside the US with Employment Authorization Document (EAD) advance parole documents while I-485 is pending?
    Any risk if I travel (about 1 month)

    Yes you can. As long as you have advance parole.

      One the reasons advance parole exists is so you can make short trips outside the US without abandoning your AOS. Yes you can take a trip. There is a low low risk of CBP deciding not to let back in but it is extremely low.

          Like azblk and MissTz1982 pointed, the risk of running into issues is low. However, within that small percentage, you have a greater risk if you had a short overstay vs an extended overstay, a criminal record, entered illegally, were undocumented until now. So if you didn't tell us your whole story, that's fine, just proceed with caution.
          If someone with a short overstay (a month) asks me if travelling on Advance parole will be fine, I am all for it. But if someone has 8 years, then I advise against it in this day and age.

            As UScitizenFilingforspouse stated make sure you were here legally all the time. If you were, I would not hesitate to travel. I went to my home country in February for 3 weeks and going to travel again in July. The only thing, make sure you have your EAD/AP card with you all the time, as well as AP papers that USCIS mailed/will mail you. (I got my paper documents about 1 month after the card itself). Also, be careful with planning your flight - short connection stops is not an option because you will be checked especially carefully on the way back to US and might have to wait a while for airport workers to check all your documents.

              Thank you, my story is i am applying GC based on EB3. My son, 16 year old, 10 grade school studying High School is F1 Visa following to me by this program. He got combo EAD and Advance parole CARD on Mar 2018. in this summer, He want to visit our home country for 1 month. I wonder can he is safety to use the combo EAD and Advance parole CARD OR NOT. do he need to get I-20 in his private school before leaving the US for 1 month

                Can you more specific about the so called "AP papers that USCIS mailed/will mail you." it were sent separately withe the card , right?

                Those AP papers were mailed to me by USCIS separate from the card - about 3-4 weeks later than the plastic card itself.
                It looks like paper with your picture in color on the top of it. It has a box for stamps on the bottom of the paper and some kind of text in the middle of that page. You are supposed to receive 2 copies of it. The airport member stamped 1 copy in the US airport on the way back from my home country.
                I don't know if it is 100% necessary to have this paper along with AP card... Since I have received this paper before my trip, I brought it with me and basically gave it to the airport worker myself when he was looking on my documents. Hope it helps...

                  Ok, so you are adjusting from EB3 to Green Card. Your son is part of that. He had a F-1 already. So the reason he could not leave once you started the AOS process, was because he did not have the EAD/AP card. Had he left, his application for AOS would have been considered abandoned. Now that he has the combo card, he is good to go. I don't think you have to show the I-20 every time you enter. But it would not hurt to have those documents handy, even if in electronic format, just in case anyone has a question. But doubt it. He should zoom through cbp.
