AOS I-485 no updates after interview

  • AOS I-485 no updates after interview

    It?s been it?s been 10 months since my interview and still no decision and my case status still reads that interview has be scheduled. My interview didn?t go well. But I was expecting to here at least something by now.
    My EAD is expiring soon and for the second time I have to renew it. I was told be my attorney that they might my show up at our house because they might think our marriage is not Bona fida. We?ve made a couple service request and an info pass which is a waste of time. It?s beyond frustrating at this point because we have no idea what is going on.

    Ok you will have to be a lil specific as to what exactly happened during the interview? Were you two separated? Was there a language barrier? Did they call you guys for a second interview?

      I feel for you. I have been there. I went through all of that with my previous spouse. A house visit is possible. However, knocking on your door is the last thing they'll do. They're more likely to talk to your neighbors, building concierge, or just sit in a vehicle and observe who goes in and out of your home. The best thing you can do, is continue to live your life, and be seen together in public. Don't be mad at each other about the interview. Be good to each other instead.

      Since you have made attempts to inquire, you can escalate this to your Senator, and have the Senator's staff inquire on your behalf. I know of someone who did that, and the Senator's office was told that they were in the middle of background checks. Days later, ICE showed up at their door. Everything was fine, because they were a true marriage. The ICE agents told the couple that someone had written a letter alerting USCIS that their marriage was **** . Ill-willed people are everywhere. That's why I tell my spouse to keep the whole adjustment of status process private. It takes nothing for someone to be petty or plain evil and pull such a stunt. I personally would love it if ICE showed up at my door. They'd find both of us here. This would be over with. Be prepared for that. If you are not under the same roof, well, you must be.

      A senator can shake the tree for you. In your case, I would definitely take that route. MissTazz1982 asked you what happened on the interview. I have to ask you the same. I am not trying to put you on the spot, but I must ask:

      1. Did you not submit all your evidence of bona fide marriage with your AOS applications?
      2. Did you submit evidence but it was not solid. strong evidence of financial commingling?
      3. How or why do you feel the interview went south? Did you walk into an ambush type of situation? Did it seem like the ISO already had made up his/her mind that your marriage is not bona fide from the get-go?
      4. Did it go south because one of you mixed up info or dates?
      5. Any previous marriages, and did you have the original certified copy of the divorce decrees?
      6. If there was a previous marriage, did the petitioner obtain a green card through that previous marriage? And then naturalized whether under the 3 year rule or 5 year rule?

      7. When is your 2nd year marriage anniversary?

        Yikes. My lawyer that prepared our file made me send the AOS application without any evidence of bonafide marriage other than the civil documents. I have talked to a couple of people who did the same and said they took them during the interview and they were just fine. I?m hope that is the case for us. This entire process is exhausting.
