  • INA act?

I am not sure whether to answer yes or no to this question: Are you applying for adjustment based on the Immigration and Nationality Act (INA) section 245(i)?

I am applying for my green card through marriage not work. I am a Canadian citizen. Any help?

        Almost certainly NO.

245(i) is for people who are otherwise not eligible for AOS -- they entered the US illegally, or they are in a non-Immediate-Relative category and they are out of status -- and they were the beneficiary of an immigrant petition filed before 2001. 245(i) allows them to AOS, by filing an additional supplement and paying another $1000.

This is my personal opinion and is not to be construed as legal advice.
