  • Owing IRS

    Hello.
I have filed joint taxes with my US citizen spouse. I had Zero income in 2017 but was able to file jointly. He ended up owing even after we used my son as a dependant. My understanding is the IRS debt will be treated as a debt for both of us not just his even though I didn?t have any income. Our plan is to set up a payment arrangement with IRS. It?s not much of a huge dept but due to me not having any income it is hard to pay it off all at once. I know immigration requires applicants not to have any iRS debt or be in some sort of payment arrangement. Will this cause any problems for me during the interview?

    All responses are appreciated.

Like azblk said, set up a plan with IRS. Whatever documented proof u have, take it to the interview so they can see u guys are making the effort. With consular processing, my grandparents' green card was on hold until my aunt (petitioner) paid off her taxes. I'm not sure how it goes for AOS.
Don't be afraid to ask the officer questions & also ask him about your EAD. I asked the officer that interviewed me and he did something on his computer & now my EAD is arriving today ☺️I will use it until my GC arrives cuz I'm too excited to work and can't on the GC😋
      Filed I-130, I130A, I-485, I-765
      Priority Date: 01/22/2018
      Date Received NOA Letters: 02/02/2018
      Courtesy Letter for i693: 02/20/2018
      Biometrics Done: 02/21/2018
      Interview(rec' approval letter): 05/31/2018
      EAD card in production: 06/02/2018
      EAD card in hand: 06/07/2018
      SSN card in hand: 06/09/2018
      GC approval/production notifications: 07/08/2018
      Card mailed notification: 07/09/2018
      I130 & I485 approval letters received: 07/09/2018
      GC in hand: 07/11/2018

Was your aunt a US born citizen? If she wasn?t then that?s probably why. It they looked at US citizen?s tax debt during AOS then I don?t think half of the people petitioning for relatives would be approved 😩. I will take everything with me. Thank you for the advice and congratulations again on the green card.

She is a naturalized citizen. Yes take all your documents to the interview and pray alot. I can testify that prayers do work!

As long as you set up a payment plan, and bring original documentation with you to the interview showing that you are keeping up with the payment plan, then you should be fine. It's also not a huge amount, like you said. Just make sure you set up a payment plan that you can comfortably afford. Ask about all your options when you speak to the IRS officer. Make sure you get an IRS officer. You have to be transferred to speak to one. It's the same Level 1 vs. Level 2 story as with USCIS. The Level 1 officers are contractors.

There are several kinds of IRS transcripts. There are federal income tax transcripts. That's basically a transcript of the 1040 form. Then you can also get Account transcripts. That would show your payment plan, the payments you've made, etc. I would bring account transcripts to the interview. Transcripts tell the ISO that it was blessed by the IRS.

It shouldn't get that far on the interview though. It isn't a tax audit. If it comes up, be ready with documentation. Otherwise, just gladly accept your green card.

I think you are right because I had the same problem with my wife when we took a big loan for the car, but my wife knew that it is my problem (because I took money on our family) and she stole the money, then went to another state with her lover. However, a couple of days later I decided to find her and ask some guys from "Debt Collection Agency" to solve that problem. So a few days later we got divorced and the children stayed with me with help of justice. I wish no one will face the same problem as I did.
