    Hello all!

    My adjustment of status paperwork (I-485, I-130, I-765, I-864) was received by USCIS on 13th December 2017. My wife's brother in law filled the initial I-864 with all the supporting documents. Long story short, got done with the biometrics and then they sent me REQUEST FOR INITIAL EVIDENCE on January 20th 2018. They asked that the petitioner should also fill out I-864. My wife is my petitioner and she did not work back then. We still filled out form I-864 and attached a letter describing her employment situation. Nothing for 5 months then now June 5th 2018 I got a pink letter saying the same thing:

    "Form I-864 was submitted, however it was not from the petitioner/sponsor........

    My wife does work now but its a temporary job. What should I do? I am so confused I am new here, kind help will be appreciated!

    I'm afraid the process is a mess. My best advice is to try in any way to cover all bases, and explain to them in a letter what you have submitted and why.

    I got 2 Requests for Evidence for 864. The most recent had 2 contradicting points, 1) my wifes salary was enough but no evidence 2) my wifes salary was not enough, please get a joint sponsor

    I called USCIS, no help, no infopass apponitments in New York ever.

    We re-submitted everything and wrote a cover letter. Even an expensive lawyer cant help you, if they dont read what you send

    Good luck, just try and be as clear and direct as possible

      Deep breath. Yes, your spouse/petitioner is by default your sponsor for the I-864. Even if you get a joint sponsor, your spouse/petitioner/default sponsor has to fill out the I-864.

      Just follow the directions, and make sure you address everything the RFE states.
