  • Marriage based AOS October 2017 - San Francisco Local Office

    Fellow members, this forum has been tremendously helpful during the long and painful process since my AOS application. I am currently on H1, been in the US for 15 years since college and have been married for 3 years now. I receievd my EAD/AP combo card after 240 days, yes 8 months and now I am waiting for my greencard interview. Now that I am onto the next stage I had a few questions , hoping experienced folks can shed some light on

    1. My 485 case still says bio-metric fee recieved on both the sites. Will it show if my background check has been completed? How can I verify if my name/background check is complete?

    2. When will my file be sent to the local office (San Francisco)? I called USCIS customer service and the person I spoke to said she cannot tell me that. So who can verify where my 485 file is sitting currently?

    3. Can I speed up the process somehow, either through local congress person or senator?

    San Franciso office is taking 11 months to 17 months, and I am at 8.5 months so still in normal processing time. But I have seen a few folks after me in San Fracisco whose status is at "case is ready to be interviewed" and wanted to know how to get there for my case as well.

    It depends on lots of factors like what category did you file your application in? Was it marriage based or employment based? What is your priority date? Is your application at National Benefit Center or Nebraska Center?

      ?Case ready to be interviewed? is no guarantee, they have sped up that process for most people in 2018 but it means not much truly, so update or no update on website is nothing. Not sure what you asked officier maybe you were a bit too agressive. 240 days is not shocking for EAD, since your H1 is valid and they are busy and dont care to give duplicate status currently unfortunately way it is.

      Anyways, since you got EAD it?s basically guaranteed your case is to be interviewed phase. That said you got 3 options, infopass ask if you at that phase. Raise an SR online, use ?i didnt get a notice in the mail? say you did not get your interview letter yet was told would get it a month ago, they will get back and very likely say ?case within processing times you queued.? Lastly get the petitioner to call and calmly ask your status and say ?is background check completed, are we at interview queue stage.?

      The information you asked for is pretty basic. But truly if you were calling too much, or raised many SRs, USCIS aint so thrilled right now so thread lightly. Personally, I would say make infopass so they can see in person you just want to confirm your case is at schedule phase and not just calling all time to express frustration, yes there is people who that.

      Lastly, California all of them have slow offices, there is nothing you can do, your wait is not even 1 year. Please do not waste your senator/congressman they going to say same thing. Sadly you live in an area with lots of asylum/daca/etc cases, when you goto infopass you will see your case is easier than 90% of cases in your field office. Those people who got interviews was pure sheer luck due to a glitch, some sent upfront loaded AOS packages to help with glitch. Once you hit 15 months then you use Senator since they will actually care then.

      Btw, I am someone in California had the glitch, led no where. Went to infopass was told at wait for interview phase. Called about EAD, was told anyone with valid i94/staus aint priority. So like yourself an easy case, sadly we just got to wait. Feinstein?s office is totally busy with keeping families together, Harris office does not even like anything but asylum cases. Good old USA.

            There are people who filed in January 2018 and interviewed in April/May 2018. There was a glitch in the system.
            Your file is at the National Benefits Center if you filed for marriage based AOS.
            If you have a compelling reason to get your green card ASAP, you may contact a senator to help you communicate with USCIS.
            Compelling reason would be - you are a researcher and were awarded a $1,000,000 research grant. You may not accept it unless you have legal permanent resident status OR are a US citizen. I read a testimonial of someone in that situation who got his green card in 27 days - thanks to a senator.
            Or you have a job offer from a government agency. The job requires LPR status or US citizenship.
            You get the idea.

              Also know someone who had an expedite application, top researcher, had 8 letters of support from varous instituions. So yes I guess if you do something like that totally possible.
