Petty offense exception

Any one with experience with one MISD theft conviction that fits the petty offense exception? I'm really nervous. Please help.

I got a theft conviction from about 7 years ago. I was on a student visa, and got kicked out of school. By the time i interview it will be about 10 years since it happened.

What should I do?

I have some community service hours. I haven't gotten into any trouble since. I don't have a removal order and I'm trying to get back into school

You need to be a little clear. Are you applying for immigration benefits or you are just trying to go back to school?

What?s your filing status? A conviction is different from a dismissal . So were the charges dismissed after community service or you were convicted? If it was your first offense, you should have been put through a diversion program which is not a conviction.

Yes there is one petty theft exemption while adjusting status. You have to make sure you have the certified original copy from the court showing that your case was resolved through dismissal. Include a copy of it in your immigration application and have the original with you on the day of your interview.
If you don?t have such document, just go back to the court where your case was handled and request one.
