  • Processing times for I-130, I-485, and I-765 that were filed seperately

    Hello everyone,

I came to the US on F1 Visa, and after graduation I got married to a USC. He filed my I-130 mid Sept 2017, and the application got approved on March 2018.
We made a copy of the approval notice and sent together with other relevant document to apply for Adjustment of status and EAD in April, 2018. We filed them separately though and I had to do two separate biometrics in June for both cases. I filed everything at NBC Chicago.
Prior to this, I was working using post completion OPT work authorization which expired May 2018 since then I have been at home counting the days. I cannot even volunteer to work anywhere.

I have not been able to track the cases using any USCIS tracker. Even when I was invited for biometrics, the status of the tracker did not change at all.

I realize I was wrong to file this late. I should have filed everything back in September but I was ignorant, and thought I needed an approved I-130 before I can file for adjustment of status and EAD.

    My questions are:
Is there anything I can do to speed up the process considering I lost my job?
Does having an already approved I-130 speed up the processing time?
Does anyone have experience with their application status not changing using the tracker?

      Expedite?

You can try to expedite based on personal financial loss. My spouse and I did that when his OPT was running out and we had the card in a couple weeks. You just need to show them that your income is needed for the family. We also included a letter from his employer, but you will have to find something else since you are not working. An offer letter, or a letter from a previous employer stating that they would like to hire you back and that you are an important employee might work. But I hear that USCIS is being very slow even with expedite requests now. Good luck!

Thank you so much for your response. I am very new to this whole process. Please could you explain more on how to expedite the processing. How do I apply for that. I can try ask my former boss for a letter since she is willing to hire me back if I get my work permit approved.

        Thank you again.

        Thank you for the feedback.
I wish you the best in all.
Please keep me updated with the process so maybe we can encourage each other.
