  • I-864 counts spouse twice??

We're filling out i-864 for an AoS for me, H1B, based on my American citizen husband's 130. In part 5, Sponsor's Household Size, it automatically fills out from a previous section the number of sponsored immigrants: 1. Then it goes on to ask if the sponsor is married, which adds another person to the count -- thus counting me twice, and leading to the tally at the bottom of that section to show a wrong total of household members. Any advice??

Come on now. I believe it says just above "people not counted earlier" then asks is sponsor married question.

As the sponsor is married and already counted spouse as intended immigrant, the answer in this section is zero.

Total number of people in the household should be correct at the bottom.

Make sure you read and understand.

The question that asks if they are married is for if the person they're sponsoring isn't their spouse and they are married.

So since you're married to the person sponsoring you, you don't count that number again. It does state that you only count each person once.

Right, that is obvious. Except the form fills in that box automatically, so I cannot put in 0; then it tallies up the # automatically, resulting in too many members of the household. Luckily I have white out. And thanks for the added condescension in your answer, that was so sweet.

Please don't use white out, the instructions do tell you that, as their scanners may not pick things up clearly.

What I did when I did it, was print that page out and write the numbers with black pen by hand. It was accepted just the same.

The box for spouse is not filled automatically. You put 0 in the box for spouse because your spouse was already counted as one of the intending immigrants.

This is my personal opinion and is not to be construed as legal advice.
