    Hi,

Thanks for the informative tips. Can you please share your opinions in my case? Currently I work in US using H1B working visa and am looking for a new job due to toxic working environment. I applied 130/131/485/765 concurrently and the case was received on 7/27.

So I need to travel back home in late November and renew my H1B visa since I haven't got my EAD/AP yet. ( probably won't before my trip)

I looked up online and it shows that I'm allowed to travel abroad leagally using H1B visa. However, some here said it is not good to travel before greeting my EAD/AP. Other than my AP will automatically expires, do you know what would cause me if I travel with no EAD/AP?

    Thanks,

    N

start looking for a job - ANY JOB. Then you can request for your EAD/AP to be expedited. You may request to expedite for the following reasons:
    1. Financial hardship to a company. (Maybe you are a student on your practical training year, are already working for X company and they would like to keep you. However, your F-1 EAD is about to expire.)
    2. Job offer - self explanatory.
    3. Severe personal financial hardship.

    • Questions about travel abroad

      Hi GA0019 and others,

I understand that AP will expire automatically if traveling with having it approved. However, I thought that it is okay to travel if one has H1B visa. Can anyone please explain this? Thanks.

      • Questions about travel abroad

        Hi there,

I post few times regarding travel abroad but it didn't seem post here. Can anyone verify that it is legal to travel if one has H1B visa and applies the GC (130/131/485/765)? I know that AP will expire. Thanks.

        • The USCIS app gives you updates on your case. And I would highly recommend making an account on the USCIS website. It lets you see the history of steps that were taken in your case.

Lucpp . Mentioned you have h1b and you also applied for i485 . So in this situation if you are travelling, you can use your valid h1b status to re enter (with same employer) , if you use AP to reenter your h1B status will be automatically terminated .so if your valid h1 b to reenter and same employer , you wont have a problem.

              Hi Lucpp,

My case is similar to yours but i'm in no rush to travel at this moment and i did not even apply for my AP. I honestly believe that while your AP is still pending shella **** ** site mentioned its not recommended to travel, but if you have to then i think you might end up travelling on your current status and then comeback and may be reapply if you need AP. PLEASE CONTACT **** **.COM team, they are the best but comes with a price.

              • EAD Cards in Production

                Hi All,

Today at 3pm I have received text messages and emails informing me that both for myself and my wife I-765 has been approved and cards are being mailed. This is a great news because next week by it would have been 90 days since our biometrics.

There is no progress though on our I-485 and my wife?s advance parole application I-131.

What I am really confused though it?s a great news but how can I-765 be generated before our final green card interview? My case is employment based green card.

I feel very happy right now at least some progress have been made. Hope you all best of luck. Just keep praying and have lots of patience.

I had previously posted few times on this forum and my most relevant post is here.

                  • I asked this question previously because I was seeing alot of people on this forum that had "case is ready to be scheduled for interview" a month after their biometrics.
I filed on 06/28 and mine still says "Fingerprint reviewed" and my I-765 got approved.

I do know though that if your green card interview was scheduled BEFORE your I-765 was approved then you wouldn't get the EAD since the work permit is a way we can work until the interview. Why get an EAD when you can just get your Green Card

Not quite. They're processed on different factory lines. The interview depends entirely upon the field office, and how fast it is. Now, the NBC may focus on processing EADs for folks in slower jurisdictions. That's different. We've seen people get the EAD right after the interview, as well, and then shortly after, they green card arrives.

Yeah, if you ask most lawyers, they will tell you there is no way to expedite.

The EAD/AP are dependent upon clearance of your background checks. We know that it is possible to have the interview scheduled before background checks clear. People get to the interview and are told - your background checks are not finished. Those same people also have not gotten a EAD.

I am getting desperate as well.
I have been applying for jobs starting in January, and of course when they see my resume and I say I just moved here from Canada about 2 years ago to go to school, they always ask if I will ever need sponsorship, I say no, but I am terrified that I might miss a good opportunity, if I don't receive the work permit in time, plus not having money is no fun. I really don't want to get a job offer, and then expedite, I don't think the employers will understand. A few of my classmates are refused employment as soon as they say that they might need sponsorship.
Does anyone know why they sent the email about the update in September but didn't say what the update was?

hoping and praying for the best, for all of us. Good luck!!!

Well there's no such thing as missing a good opportunity as ud always get better offers if one doesn't work trust me.. We can only keep hoping... I get that same message every two weeks and someone here said it's a system thing... Well... Fingers crossed... Its all good... We wait
