    Immigration is a very political subject, unfortunately. And while the rules are promulgated as laws and not always quick to change, the administration can heavily influence where limited resources are allocated, and the political climate can dictate where USCIS gives people a hard time, where they're more forgiving, and which internal memos they're using to adjudicate petitions, whether or not those memos have been opened for public comment.

    And regardless of what the political climate is, it's something people should be aware of, and should know that it's apt to change.

    There are a lot of things I wish weren't political, but posts pointing it out or not aren't going to change that one way or the other...

      AOS is a discretionary benefit for most categories _ the administration can change or make it very difficult to adjust status. With Jeff Sessions now over ruling the EOIR and IJ's at will you never knew how far they are willing to go until the federal courts put a stop to it.

        We went ahead an got an attorney and then it got even worse. I married my wife back in 1997. I just found out while doing a background check that apparently in the very early 1990s and while in college I married a girl(a citizen so no immigration thing). I do not even remember her. I had to sit there for hours trying to remember her and this is what I came out with. Apparently we did some stupid college thing and got married. She moved away a couple of weeks later with the divorce papers and apparently never filed until nearly a decade later in 2001. I had to call the courthouse and get the information on her name. I literally do not remember anything about her. This makes my marriage to my wife invalid after nearly 21 years of thinking we were married. My attorney told me since the marriage was technically voided and not real we do not need an annulment but will have to get married again. He also stated I needed to put together a sworn affidavit stating what happened and how it was unintentional. Now I will go into an interview once we get the paperwork together as a newlywed with tons of restrictions and will have to explain to a skeptical immigration case worker what exactly went on. This is a nightmare. We have been married for over 2 decades. I have proof of us being together all that time and now none of it counts. If anyone has any suggestions please let me know. This just keeps getting worse and worse.

          You worry too much. You just need to get married right now and go from there. Just make sure you get the divorce papers from your first "marriage" - you will need them.

            Go to the courthouse at 8:00am on Monday morning, if you haven't already. Marry her immediately.

            Your proof still counts! The weird marriage situation does not make your life together less real or valid, and it doesn't make it less valuable as proof of a bona fide relationship.

            She will have to get the conditional GC, but that is not such a big deal.

              how do you not remember marrying someone?! like even if it's a stupid college thing there had to be an ordained religious leader or justice of the peace or something there officiating it! But as Ember said, go at 8:00am Monday morning and get married! and may you have best of luck
