Whats the difference between I-130 and I-485?

  • Whats the difference between I-130 and I-485?

    I filed all these forms together, like most people seem to do.

    I'm assuming EAD and AP are National Benefits Center

    When I check processing times for I-130, it only gives me 5 Service Centres, no idea

    I-485 I understand would go to my local office, Brooklyn

    If I have EAD and AP approved, how do I know what stage in the process I am in

    Initial date receieved 09/26/17 and first RFE receieved Nov 8th, second RFE recieved May 4th 2018

    Since u filed concurrently u don't need to check i130, only check processing times for i485. I485 is only transferred to the field office when it's getting ready to be prepared for interview. My case was transferred to my field office on May 15th. Check my timeline below. I765/i131 applications go to a different location ONLY after your package has been accepted and cleared of RFE's.

    EAD card in hand: 06/07/2018
    SSN card in hand: 06/09/2018
    GC approval/production notifications: 07/08/2018
    Card mailed notification: 07/09/2018
    I130 & I485 approval letters received: 07/09/2018
    GC in hand: 07/11/2018

      EAD (I-765) & AP (I-131) are worked differently. You filed concurrently so as kaylip said, the I-485 is the main one, that's the one that your interview is based off of.

      Your I-130 establishes that the relationship between the petitioner and beneficiary is legal and bona-fide and the I-485 is to adjust status to become a legal permanent resident, hence the need for the interview. In general with this, you're more likely to receive updates on your I-485 as you are on your I-130.

      4-14: Picked up by USCIS
      4-19: Email & text notifications received
      4-23: I-797 Receipts received
      4-27: Biometrics notice received

      6-04: Interview scheduled
      6-09: Received interview letter
      7-10: Interview complete & approved, status change to New Card being Produced
      7-13: Card was Mailed
      7-18: Green Card in Hand

        Thanks its so frustrating not really knowing how it works. I waited months for my EAD, and when it finally came i expected a dual AP card, that didn;t happen. When I called and wrote and did everything I could, nobody seemed to know or care. I understand its a lengthy process and that a lot of people are in the same situation, but wondering if something or everything could be lost in the mire is very unsettling

          I understand your feelings, for sure. I am pretty confident everyone going through this process comes out of it with a blood pressure higher than before they submitted their forms!
