  • I864 Affidavit Of Support income requirement

    Hello Friends.

    I am little bit confused regarding income requirement into form I864.
    my wife's last year total income was around $33,000 but in her tax return her adjusted gross income shows around $19,000. my question is which income should be considered as per the poverty guideline? if it is gross income then I will have to find joint-sponsor.

    They use gross income, so in your instance $30,000. Make sure you provide evidence of that income by the way. Apparently its one of the most common reasons RFEs are issued!

      Thank you so much for your reply. so if I don't file joint sponsor I can still file i864 with total income of $33,000 with evidence. right ?

        If your sponsor has evidence of earning over the 125% HHS poverty guidelines then you do not need a joint sponsor on form I864. You still need to file the form, but won't require a joint sponsor.

          My sponsor has last 2 years W2s, last three years tax return transcripts, Employer verification later and last 3 paystub. do you think I need anything more than this evidence. ?

            If you have tax transcripts from 2015,2016, and 2017 you won't need the W2s. You only need those (as well as a copy of the tax return) for years that you don't have a transcript for. If you don't have the 2017 transcript, you will need a copy of the sponsors return along with the W2s. If you have the employee verification letter stating the sponsors annual income along with her job title and responsibilties, you won't need the paystubs.

                I think you need to read the directions. The I-864 is the cause of most RFEs. The instructions state they look at line 22 on form 1040. That's usually higher than adjusted gross income. Current income, on the other hand, is what you've earned so far since January 1st, 2018 but projected to the end of the year. That's why you submit paystubs as evidence of current income.
