    When i check the processing times for NYC, i'm given 2 categories. Which one do i use? I am a USC filing for my Husband. Will that be considered "Family Based" even though he is in the "Immediate Relative" category? I know i have a long wait either way, just curious

    Estimated time range Form type Receipt date for a case inquiry
    12 Months to 23.5 Months Employment-based adjustment applications July 22, 2016

    14.5 Months to 24.5 Months Family-based adjustment applications June 27, 2016
    3/21/18 - file (I-765, I-485, I-130) received by NBC
    4/2/18 - Received 3 receipts for 3 cases
    4/2/18 - Received biometrics appointment
    4/27/18 - biometrics complete
    7/6/18 - I-485 Ready to be scheduled for interview
    8/10/18 - EAD in Production
    8/13/18 - "We approved your case" I765
    8/16/18 - We mailed your card to you

    yes it would be considered family based. relatives are considered family

          It gives you a breakdown of each category. When you have these many data points, you may assume that the ratio/percentage of each subcategoru will be similar at each field office, *Though, not all are adjudicated at field offices. In other words,

          Total family based = 356,080

          I-129F Fianc?e Petitions-----------------------11,460------3.2%
          I-130 Immediate and Preference Relatives 199,214 ----56.0%
          I-485 Family-Based Adjustments ------------85,009 ----23.9%
