  • Interview Waiver?? Is it possible?

    I have my 485 pending since October 2017 and my PD is Sept 2016. I called USCIS customer service wanting to check status for my interview scheduling and the level 3 customer rep told me that I have been waived for interview. They don't know when my case will be updated but from what they can tell it has been waived for interview.

    Is that possible? I am a F2A and married for the last 4 years, have been in the US since 2003 as a student and then on H1B. Still currently on H1B.

    I am wondering if this is accurate or just bad information given by the rep? How can I get it verified?

    Here's a list of reasons a waiver may be permitted. unfortunately it does not appear that you fit into any of these categories. https://www.uscis.gov/policymanual/H...tml#footnote-3

      The USCIS policy manual states that marriage based AOS petitions require an in-person interview. Petitioner and spouse must be present. Now, is it possible that this is ANOTHER glitch and that you might end up benefiting from it? Yes, it?s possible. We all saw how a system glitch scheduled employment based interviews for marriage based applicants. Some of the field offices even had pending applications from 2016 and 2017.

      Two things may happen. They may either start waiving interviews for marriage based AOS petitions if the couple has been married for at least 2 years on the date the case is adjudicated. OR here?s an alternative. They may change the 2 year conditional permanent residency to 3 years. Before the Interview rules changed for employment based AOS and relatives of Ashlee?s changed, USCIS was alreadyway behind in adjudicating I-751s. Right now it takes 18 months or longer to adjudicate an I-751 removal of conditions. So if people are waiting at least 3 years for the 10 year card, then why not increase the conditional period to 3 years?

      That being said. If it happens, take it. But make sure it does not back fire on you later. So check with a lawyer.
      Truth is that level 1, 2 & 3 officers are all at the contact center. They?re not at the NBC. My feeling is that they?re all contractors. And based on their erroneous interpretation of the Case inquiry date, I have no choice to believe that most are misinformed and don?t know their stuff. A level 3 tried to tell me that the Raleigh-Durham, NC field office is processing applications from May 8th, 2016. Seriously??? That?s about 25 ish months. The current processing time estimate is 11 to 26 months. That?s the reason for the case inquiry date. We all know Raleigh is interviewing March applicants already.

      So take it with a grain of salt, or call again.

        The only AOS interviews that are waived are K1 visa & I751 applicants. Some are waived. Still gather documents and be prepared in case you get an interview notice in the mail.

          Supposedly, all k-1 applicants who filed for AOS after April 17, 2017 are required to be interviewed. And for I-751s, people are praying for being selected for interviews because It tends to be faster.
