  • RFE on Tax documentation and I-864

    I received an RFIE to submit all supporting tax documentation for the most recent tax year. My husband and I filled jointly in 2017. I submitted the form 1040 and a copy of our W2's to USCIS. What other tax documentation can I send for the RFIE?

    Also, as the beneficiary is my income considered when calculating the 125% poverty guideline for the purpose of form I-864?

    Please Help!!!

    Your income is not included in part of the 125% income. Your USC spouse income counts. If you had I-864 Affidavit support ( sponsor ) their income will count but you need to count how many people in the household.
    So if your 2017 Tax was filed jointly, USC income has to be 125% poverty line. Not including both of you.

      Your income is included if you are the spouse and love under the same roof. I read this on the instructions for i-864
