  • AOS package returned

My husband and I sent in his AOS package in early march, it was returned to us at the beginning of April for "incorrect fees". We double checked the fees on the USCIS website and re-submitted the package the 2nd week of April. (His 1-94 expired 04/03/18) after weeks of waiting, the package was returned to us the 12th of June for incorrect fees. We called USCIS and double checked the fees with 2 people. Checked the website again. We have resent the package but Im worried because his I94 is expired but the package kept coming back. We included the fees for the 485,130 and the biometric services fee. We've confirmed with USCIS what the fees are so we can't understand why it keeps getting sent back or why it takes so long to get back to us. Is this going to present a problem? We've kept the receipts for the postage for each submission and the paperwork that came back stating the fees were incorrect.

ETA: We've called the "customer service" line several times, when we received a call back, the first time we were told the fees were correct... the second time the man told us "it can take up to 30 days" whatever that means... the third time the fees were once again confirmed to us.

Just out of interest, and to triple or quadruple check for you, what are the fees you're submitting?

People aged 18 - 78 must pay $1,140 + biometrics fee of $85 for the I-485 which totals $1,225 on one check
The I-130 fee is $535 which should be on another check.

You should have 2 checks each with the corresponding amount, one attached to the top page of your I-485 application and one attached to the front page of your I-130 application.

Instructions from USCIS on paying with checks are here: https://www.uscis.gov/us-visa-and-im...ing-uscis-fees

      Thank you for your response...

We did send two separate checks the first time, totaling 1760.. one for 1225 and the other for 535. The second time we sent it in, we sent in the authorization form for the credit card in the amount of 1760.

That is strange. The hand writing is correct? One thousand seven hundred sixty and 00/100; the other is five hundred thirty five and 00/100
which bank did you use for your check? could be the problem of the bank

I've gone over the check and the credit auth. form and everything is fine.. the bank is USAA.. they said there wasn't even an attempt to cash the check. Im just really worried that when/if they do finally accept the packet and cash the checks, it will all be denied because his i94 is expired now.

Him being out of status when you apply for AOS doesn't matter then as you're a US citizen, so don't worry about that.
