  • CA Driver License during pending AOS

    Hi,

    My i-94 and California driver license will be expired on July 9th. I have applied for AOS card since Feb 18 and haven't received EAD/AP to renew the driver license yet.
    Can I use my un-expired international driver license meanwhile? Or shall I apply for an AB60 driver license? Is there any risk to get an AB60 driver license? will it impact the green card process in the future?

    Get ab-60 get real ID once EAD arrives. AB-60 cannot be used as federal id thats it.

      Thanks. If I apply for AB60 and later on I receive EAD, can I switch from AB-60 driver license to a regular one?

        Yes with proof when speaking to DMV why you couldnt renew your license and why they gave you an AB-60 for time being.

          How many years

          How many years do they put on your real ID when you get it through EAD? A year?

                Sorry was in a rush. Real ID will match your i94 expiry, so for EAD 1 year then when you renew gotta go back to DMV. The AB-60 think is 1 year as well.

                  I filed for AOS in Los Angeles last year (January) and when I got my EAD in (delivered on 5/11) I made an appointment at my local DMV to get a CA ID. My appointment was on 5/25 and I received my ID on 6/3 and it was valid for the duration of my EAD (so it was valid for a year more or less). My AOS interview was on 6/7 and I was approved the following day and I was thinking to myself I should have waited a few days so my ID would have been valid for the full duration and not just a year.

                  Anyway I was looking into the requirements for getting the REAL ID to replace my expiring ID with and I received a letter from the State indicating I had received a time limited ID and to fill out the enclosed and I would receive a replacement ID free of charge that expires in 2022. If I had wanted to get the REAL ID then I would have needed to go to the DMV and apply in person again and pay for it, but as I have my green card for a Federal ID I just opted to take the free replacement card that is valid until 2022.

                  I'm not sure all states operate this way but in CA they will send you a notice and a form to fill out to replace your time restricted ID / License. I don't recall if I had to include a picture of my green card or the A#. But it was all very easy to do and the instructions on the form were very clear and straightforward.

                    Yes correct process, you will need a new ID in 2020...once its fully enforced at California airports. But so will every citizen who lives in the state who has not got a real ID.

                      Alternate forms of identification are acceptable if you do not have a REAL ID, such as green card, passport, military ID.

                      The Transportation Security Administration (TSA) will begin posting signs at airports this week notifying travelers that beginning January 2018 it will start enforcing REAL ID requirements at airport security checkpoints, meaning that travelers seeking to use their state-issued driver’s license or identification card for boarding commercial aircraft may only use such documents if they are issued by a REAL ID compliant state or a non-compliant state with an extension.


                      TSA?s notification follows Secretary of Homeland Security Jeh Johnson?s announcement earlier this year of the final phase of implementation of the REAL ID Act.                       The REAL ID Act, passed by Congress in 2005, establishes the minimum security standards for state-issued driver?s licenses and identification cards and prohibits federal agencies, like TSA, from accepting licenses and identification cards for certain official purposes, including boarding federally regulated commercial aircraft, from states that do not meet these minimum standards and have not received an extension for compliance from DHS.
