Correct me if im wrong but it shouldnt matter to them because AP should be presented at the port of entry. Based on my experience, my AOS through marriage has been pending for a year and since I already have my approved AP, I just brought with me all the necessary copy of the documents they might ask for like our marriage certificate, approval notice for my AP and I printed out the most recent update of my case on the USCIS website. I know it?s scary but when you think of it, they wont issue an AP if it?s something you cannot use. Hehe

Thanks for sharing your experience everyone. We've been wondering whether or not to go however our attorney suggested staying in place until we've got the GC in hand. I think we will follow the advice of our attorney. It's just risk we're not wanting to take. Precautious I guess.

At the Port of Entry you're an arriving alien and not considered in so if something goes wrong or the officer just wants to be a dick they can do that and there's nothing you can do.

Airlines travelling to the USA have responsibility to check for valid immigration paperwork. Two airlines staff told me this on different occasions.
