  • I-485 Post AOS Interview

    Hi All,

    Filing Location: San Francisco
    I-130: Filed 12/20/2016
    I-130: Completed/Approved 5/5/2017, sent to NVC.

    I-485: Filed 5/20/2017
    I-485: AOS Interview 6/29/2018

Here is what happened. I filed the I-130 separately from the I-485. Reason being at the time my spouse did not have a visa to enter the US in Dec 2016. Then in late Jan early Feb, my spouse was approved for her L1 visa. Spouse arrived into the US on Feb 12th, 2017. I then proceeded with gathering all the docs, paperwork and forms for the I-485. I filed it at the end of May 2017. The I-130 was approved in early May 2017. USCIS never merged the I-130 with the I-485. We had our AOS interview on the 29th of June 2018. Officer was very chill and nice. He asked why did I file separately, I told him the story above. I showed the Officer my receipt and made a copy of it showing the I-130 being approved and sent to the NVC. Officer tentatively approved the I-485, however, due to the I-130 not being there he could not approve the entire application. Officer told me he will ask his supervisor if they can go ahead and approve the whole thing, despite not having the I-130 at the field office. I gave the officer the copy of the receipt and he told me it might be approved in 30 days.

Does anybody know if it will be approved in 30 days or will it likely take longer? Anyone ever been in this situation?

30 days is the standard amount of time they tell you if they can't approve on the spot. It seems it usually does happen within those 30 days. But once those days are up, you can call and enquire about it.
