Form I-765 for EAD- Outside the normal processing time

  • Form I-765 for EAD- Outside the normal processing time

    Thank you all,for your help all the time, I need an advice because my Form I-765, file, for Employment Authorization is outside normal processing time and no EAD yet.

    As of today my case is 6months old, on its 184 days, I still don't have work authorization. RFE was requested for and our response was received by USCIS on June 19,and that was the last update I have. (The RFE request was for 2017 tax return of my sponsor. And we even sent 2017 of my joint sponsor, 2016 tax transcripts of my sponsor, and our joint filling for 2017)


    The date on the receipt number for form I-765 was January 2 2018.

    And currently the National Benefit Center is processing EAD for January 15,2018.

    While California Service Center is processing the same document for February 6, 2018.

    These information was gotten from USCIS website on processing time.
    Thus it is clear my Form I-765 is outside the normal processing time.

    Kindly advise on what to do, I had a job offer in April 2018, with proof of financial hardship reason we contacted the congressman for help,and that was when the RFE was requested, and we have since sent our response(as stated above) to it, and it was received on the 19th of June.

      Three times. His office is also aware that I don't have EAD yet.

        I had a similar wait. About 6 months. I was told that when I had my RFE that put my case back to day 1, and the EAD is directly linked to the case.

        This may not be 100% accurate but that is what I was told by USCIS. Its really hard to get 100% info.

        Contact the USCIS Ombudsman too

          I think you should bring this up to your Senator's attention. They can usually shake the tree a lot harder than a congressperson can.

          You can also call and ask for a level 2 officer. Tell the Level 1 you are escalating the call, say you need to expedite if you have to. Tell them you will only speak to a level 2. Once you get to the level 2, share what is happening. Ask what was the last action taken on your case. They can see actions that we cannot see on our end. If that gets you nowhere, as to speak to a supervisor.

              Bit confused, how long did you take to answer the RFE? Did you tell the congressman office you got and when responded?

                4 weeks. Yes I did. The congressman is aware of the RFE.
                The congressman's initial enquiry on my case led to the RFE and they were aware when I responded and when USCIS update my status That they received my RFE.

                  Pretty unfortunate thats a tough RFE but essentially those 4 weeks the timeline was totally frozen. Do you have a current job offer now or reason to expedite? As well a job offer in April would have been almost 6-8 weeks your file could have been stuck,so truly in USCIS eyes you are around 120-130 days.

                    Surprisingly, I just got a status update now that I have being schedule for interview as of July 3rd, that the notice will come in the mail. No EAD approved or received yet.

                    We need prayers plus our preparation right now. Don't know how soon the interview notice will be in the mail and the date.
