  • Co-sponsor responsibilities

    Hi there!

Right now, we are looking for a co-sponsor. But I'm not sure what are their main responsibilities while in the process of Green Card. Are they responsible for me until I get the card if something happen to my husband? What should they do while i'm still in the process? Any help would be appreciated. Because I'm not sure what to tell them if they asked what should they do, or at least they will know what to expect. Thank You guys

You should really tell them to read the i864 themselves and see if they are comfortable with what it says. They need to provide 10 years of support to the applicant.

Also they need to be comfortable giving their w2/taxes/employer-statement since the evidence may be asked upon.

The obligations are not for 10 years. The obligations are forever, until one of the conditions for terminating the obligations occurs: the immigrant becomes a citizen, earns 40 quarters of Social Security credits, abandons permanent residency and leaves the US, or dies, or the sponsor dies.

A sponsor has no obligations before you get your green card. Their obligations only begin when you get your green card. Basically, during the duration of their obligations, you can sue them if they do not supplement your income (if your income by itself isn't enough) to 125% of the federal poverty level. And if they don't supplement your income to 125% of the federal poverty level and you use a need-based government benefit, that government can sue them for reimbursement.

This is my personal opinion and is not to be construed as legal advice.
