  • Will I Send the Same Documents?

    Hi everybody,

    I was just wondering something about I-751. I still have time to send my documents to remove conditions but just have some questions;

    1) Am I gonna send the same documents that IO kept the copies at the AOS interview? Basicaly, am I gonna merge the AOS documents with remove condition documents?
    2) I will have so many bank statements and phone bills till I send my documents. Can I send all of them or I should pick some and send a few of them?
    3) I will be having 3 years of tax returns (2017-2018-2019), can I send all of the papers in my tax return folder? Why am I asking that? Because there are so many papers in the tax return applications, if I send all 3 of them, it?ll be about an inch (maybe more) thick 😅
    4) Do I need my lawyer for this document preparing or is it complicated then it looks. I know, this is up to me but just wanted to hear your opinions 😄

    The reason I?m thinking all these early is I already started to collect some papers and receipts that shows our life. I have a very good ideas about how to arrange the documents and photos by checking other applicants I-751 documents. Also new rules and regulations are pushing me to do this now, to be ready for this and keep every single document and detail I can just to make my papers bold and nicer.

    😂I did the same and even downloaded the naturalization forms!
    When u send in your evidence you send in a continuum of the evidence you sent for your AOS along with new evidences of co-mingling of finances and cohabitation. Don't send the same docs just updated ones to it. Tax returns are just 3 or 4 papers not sure how u have so many.
    Using a lawyer is up to you.

      Tax returns can be 1000s of pages. Tax transcripts which you should send are much less pages.

        Okay, so did I understand it correct?

        I will put the AOS documents aside, all the other documents like phone bills or bank statements etc. will be sent from the date after I got my GC, correct?

        What about some of my documents that my IO didn?t look at them at the interview? Such as employment letters, a letter and bills from my inlaws shows we live together, concerts and comicon tickets, emergency contact pages from my school and my husband?s job? Can I add them with the new documents as well? Because he didn?t look at them at the interview.

        By the way, we get our tax return done in H&R Block. My lawyer added all the papers on the 2017 tax return which includes some H&R Block regulations and rules papers. That?s why I said it?ll be a lot. There are around 50-60 pages on our last tax return 😂😂

          They do accept IRS transcripts in lieu of the tax return itself. So for the purposes of filing and sending your packet through the mail, I'd advise sending transcripts instead.

            I plan to use the documents the officer didn't look at in my i751 packet as well. Generally AOS u have the burden of showing proof of the relationship whilst ROC is showing proof that you're still married to the same person so sending evidences from the day u got married is mandatory. Be sure to make that concrete evidences.
            My husband usually do his on TurboTax website. For the interview he just printed the tax return document (1040) All the other documents he didn't print. Just the tax return and the TurboTax confirmation.

              When I fill all the applications for AOS marriage based. I went to non-profit organization that help immigrants here at the DMV. They have been assisting many immigrants for years, the best thing they charge me just $400 to help me fill all the applications, to tell me and organize all the evidence attached to the application, and even made the envelope. I think that in every state must be an organization like this and try to avoid the highly payments to a lawyer who is going to do the same (obviously every case is different and if is a simply one why don't skip the lawyer). I highly recommend to look for this kind a organization before send something.

                That?s a very good idea. I was thinking not to go back to my lawyer and pay money again but this option is very good idea. Also there?s LGBT center in Manhattan which they provide free consultation about immigration and other stuff. I might go there with my documents and ask them how to fill the form and how to put documents together. I am sure they will help me. I should do that just not to pay more money. Actually I don?t really know if my lawyer is gonna ask more money to send I-751 (probably he will) but if he says he?s going to charge it, I just go to the LGBT center and get some help there for free.

                I got it. Very good! I will just send them the important parts of the tax returns, so they don?t bother themselves with other unimportant pages. I am still thinking of what to add on the new papers. I will try to get another credit card next year and add my husband as an authorized user. We purchased a bed with credit from Mattress Firm. I will add myself as an authorized user on it as well. Thinking of what to get... maybe I add myself on the car insurance when I get my drivers license because I went to the interview with a state ID 😄😄 other than these, I pretty much have everything. Now it?s good to add more entertainment papers like concerts or movie tickets we go together or trips we go together...

                Also I think somebody should start a new thread about I-751 on this forum, there is no any as far as I can see 😄😄

                  1. Remember that the I-751 is only adjudicated at the field office IF they select your case for interview. Historically, less than 10% of cases are interviewed. That's of course, added to the backlog. It would be impractical for Service Center to request your
                  I-130/I-485 along with the evidence. So even if it seems repetitive, yes, you would submit documents you have already submitted. The focus is from the date of the marriage until the time you file.

                  2. ROC packages are typically huge. I strongly suggest that you read the instructions carefully. Do not be misinformed again. People will tell you that if you submitted January 2018 - July 2018 mortgage statements, then you do not have to submit them. Well, the instructions do not address that. All it says "from the date of the marriage until the present date". So if you got married before January 2018, then yes, they're expecting that. I recommend following the instructions. "Oh my cousin sent only recent documents and it was fine". Well, if it goes south, you don't get to say that your cousin was approved on less.

                  3. Regarding tax transcripts. Please see screenshot below. It states "If you provide a photocopy of your Federal individual income tax returns, you must include a copy of each and every Form W-2 and Form 1099 that relates to your returns. Do not include copies of these forms if you provide an IRS transcript of your Federal individual income tax returns rather than a photocopy unless you filed a joint income tax return with your spouse and are qualifying using only your income."

                  **** In other words, include W2s and 1099s if you filed a joint return with your spouse and are qualifying using only your income. ****

                  4. No, you do not need a lawyer.
