  • Help.. Job interview. What do I say?

    NBC is processing EAd

Hey guys, so I've a job interview next Tuesday and I have no idea what to tell them, with regards to my EAD and social. I applied for my EAD along with i-485 in Feb. And up until now, I'm on day 151 btw, I haven't received my EAD. Went for an infopass last month, they told me that someone has my file and I should be receiving a notice soon. And that if i don't after 30 days, I should go back for another infopass and see what's up. so yesterday, I went for another infopass, and they're telling me the same thing again, that someone has my file and that I should wait.

I've a job interview next week and I really need this job, but I just don't know what to tell them with regards to me not receiving my EAD yet. I'm scared they wont offer me the job because they want to hire someone right away and I might have to ask them to wait. But i don't know how long I should ask them to wait.

    Any thoughts?

That is a tough spot to be in but as far as I?m aware by law an employer is not supposed to ask you about EAD until the first day of your employment with them. I hope someone who is more knowledgeable answers your question. Good luck! And congratulations on securing an interview.

All they may ask you BEFORE hiring you is: Will you now or in the future require sponsorship for employment authorization? You just say no to that. Then on your first day of work, you will fill out the I-9. That's when you will have to present documents that show you are authorized to work in the US.

With the job offer, you should be able to expedite. Just make sure you get it on paper - an email.

I recommended to you reaching out to your Senator a while back. I still think you should. The NBC is going to continue fiddling around with the Case Inquiry date. Other service centers are burning through combo card applications.

Usually before the interview you have to fill out an application where there might be a question that asks if you are authorized to work in the US. Unfortunately, right now you are not so you have to put the truth in your application.
I was in a similar situation a month before I received my EAD and I didn't get the job because I couldn't present proof of eligibility to work in the US at the time.
        Good luck.

You can explain to them the truth about what is happening sincerely. Like you applied for ead but they still don?t decide yet and if you get the job offer you can expedite and they should give you the ead. Say that you can start once you have it. Just be confident and get the job. It depends on how you talk to the employer.
If possible you should try to reach lv2 officer to expedite. You can say it is an emergency, my job starts on ... and i have the evidence.
They should take up to 3 weeks from the time your expedition is approved to when you have the ead in hand.

Thanks for the response guys !

So when I asked the lady at the infopass what I should put for "Eligibility to work in the USA?" she told me that I could could choose the option "US permanent resident holder"

So when I applied for a job, they asked me that question on the application form and I put it as that (as instructed by the immgiration officer at the infopass) and when they called me for a phone interview, they asked me if i have gotten my greencard, I told them that I'm in the process of getting my greencard.

And now they called me back for a physical interview next week. So I guess I could just tell the truth and be like "Once i get the offer, i could expedite it." I really hope they would understand and not be iffy about hiring me or take back their offer.

I thought emergency is for "Financial loss to the company" kinda thing?
I only need the offer letter as evidence right?
What if the company asks me how long do I have to keep them waiting?

And I've contacted both Senator and congressman last month, and nothing happened. Noone got back to me. so my husband kinda gave up on them. :/

I'm in a similar situation. I've filed i485 in October 2017 and graduated in May. On online job applications I was basically saying that I'm authorized to work in US (different employers ask this question differently - some ask "are you citizen/permanent resident/asylee", some ask "will you require visa sponsorship" etc) and made a comment in cover letter or elsewhere in application about my situation.
During phone/in person interview I was as honest as possible and said that I have applied for family-based greencard, I am eligible for EAD but it is already way past normal processing time so I have absolutely no idea when I will get it (job interview was in late May). I eventually got an offer and employer agreed to be flexible with start date.
You should definitely mention the possibility to expedite if you are offered a job. I did not know about that at the time of my interview.

PS. I am on day 284 (!) and still no word about my EAD

You can say emergency if you have a date to start. Just say my job starts on ../../.. . Let them give you the offer in writings like email or paper indicate the starting date.
Please tell your husband call them. Let he be your behalf and you two should sit there together and talk on the phone. Try to reach to lv2 if you can. Tell him to mention : i have the evidence ready.
I did the same thing. My case is financial loss to company. I have the letter from employer. They acceptd my expedition.
