  • Proving bonafide marriage without SSN

    Good morning all,

I am a USC filing for my husband and i want to make sure i am well prepared for my interview whenever that may happen. We recently received an update on our AOS stating that our case is ready to be scheduled for an interview. I know that we can be waiting for many months - a year for an interview but i do have some questions. We have yet to receive an update on the EAD so my husband is still not working and does not have a SSN. IF we were to be called in for an interview before the EAD comes, how can i prove that we have a bonafide marriage when there is little to no accounts he can get without an SSN?

    Any help would be appreciated
    3/21/18 - file (I-765, I-485, I-130) received by NBC

    8/10/18 - EAD in Production

I had the same issue. My interview was scheduled after 3 months, I never received the EAD or SSN. I just focused on proving other parts of the relationship. Daily text message conversations about how crappy the day was, remember to get something at the store. I also included Skype chats between myself and my parents and grandmother to show my family knows about my wife. I also included Advanced Directives, with myself and my wife giving each other power of attorney with health matters. Lots of photos from the very first we ever took and a selection of photos through our journey together. Tickets of places you've been, receipts of things you've bought together. Old emails that you've sent each other with dates showing the longevity of the relationship. As well as some Affidavits from friends who have spent time with you as a couple, went to your wedding etc.

If you get your interview before the EAD/SSN they are going to understand your finance information is going to be limited - at least the one we had understood. And I explained it from the start. When he asked if we wanted to submit any other evidence, I gave the stuff I mentioned above and stated EAD situation and he understood. He simply said that it's going to be the ROC interview in 2 years time that they will look very hard at finance and co-mingling.

If your relationship is bona fide, then just show all of the stuff I've mentioned, they will see it's real from what you show and from your reactions between yourself and your partner.

Hello there are several pieces of evidence that may not require SSN. These may include pictures, movie or theatrical performance tickets, restaurant receipts, gifts and/ mails from friends and family, joint store cards such as Safeway, Best BUY, joint pet medical documents, record of exchanged text or email messages, printout of friends' comments on you both as couple on ******** or Instagram or social media. Also affidavit of friends or family that shows knowledge of your relationship. Plane tickets, museum tickets, rent or lease or document from family member or friend to support where you live, gym or YMCA membership cards, being placed as authorized user on partner existing credit or store card, added to each other's existing health, car or life insurance, shared house key, shared parking sticker (apartment living), couples spa ticket, marriage license, employment document that shows each as emergency contact, visitor's sticker to each other's company or workplace, gifts to each other and so much more

      All the best.

I didn't have an SSN either and with help from other users I was able to come up with creative ways. This thread may be of some help to you. https://www.immihelp.com/forum/showt...interview-tips

This is one of the reasons that adjusting status from non-immigrant visas that do not allow you to get a SSN is not recommended. Anyone adjusting from B1/B2 really should have pursued the k-1 route or IR-1/CR-1 visa via consular processing. My husband is adjusting from F-1 visa which is already terminated by now, and we see now that k-1 or IR-1/CR-1 would have been a better option.

You can't turn back time. Got it. I am just leaving these bread crumbs for those thinking of adjusting from such visas to carefully evaluate their choice.

There are a lot of ways to prove your marriage is real without having a SSN. Not having the SSN does not excuse not having any evidence. Sure, a lot of ISOs are understanding but you can't rely on that.

This thread has everything you need to get creative. https://www.immihelp.com/forum/showt...interview-tips Here are a few examples:
          - if your husband is not on your lease/mortgage, then you should provide a NOTARIZED affidavit of residence. You write one and state who lives with you and he writes another one stating who lives with him, and the address, of course. The thread has a link to affidavit of residence.

          - another powerful document is an advanced health care directive/health proxy/power of attorney/living will.

          - If you are able to add him to electric/gas/water/cable/internet bills, then sign up for text notifications, payment reminders, payment confirmation. Add his phone number and yours, too. Then you will print those text notifications as they happen.

          - Create a joint email account, and have notifications, store e-receipts go to this joint email account. Use both last names for it. [email protected]

          - Pictures are not great evidence. Those can be fabricated, of course. BUT Pictures + receipts + text messages when put together and you establish a paper trail, that's strong evidence that you two were at the same place and at the same time on X dates.
Say you plan to have dinner with friends at a restaurant, then you will print any text messages regarding the dinner before and after it happens, take pictures at dinner, keep the receipt.
Then you will make a xerox of all those items on one page - a collage. Then you will add a few short sentences explaining. The following print out serves as evidence of our relationship. The photo depicts my friends Anna Jones, my mother Judy Smith, my husband Joe Jones and myself at Garibaldi's restaurant on MM/DD/YY.
The receipt for the dinner shows the bill was paid with our joint check card (make a copy of the card too). This transaction is on the MM/DD/YY bank statement (Then include the statement and highlight that).

It takes work but it can be done. I won't list all ways because I've discussed it extensively and others have also extrapolated from that and have come up with great ideas. Pay special attention to Emerald 2020 table of contents. The level of evidence looks like what you would present for removal of conditions. They've only been married 1 year and 4 months.

Look through Tezza's examples of evidence. They got very creative. They were approved on the spot.

          All the best,

          USCFFS

while all of the above answers are correct, if you're really wanting to have some accounts for him so that y'all can have more evidence, one thing they all left out is that you could always apply for him to get an ITIN(individual Taxpaying Identification Number) in lieu of a SSN, that way even though he can't work due to not having his EAD, he can still open an account and y'all can still file taxed together during tax season as well as mingle funds should you need to. Best of Luck.
This is strictly an opinion and should not be misconstrued as legal advice. The use of this information is strictly at your own risk.

I completely forgot about that! That's a great idea. I used my itin application to file jointly. When we submitted the evidence of joint taxes at the interview, they were copies of the Tax Assistance Center stamp on each paper that said, "Submitted as of 00/00/2018". The ITIN takes quite a while though and this user may not get it in time.
