Can Petitioner for parent( I-130) be the preparer /translator for I-485

  • Can Petitioner for parent( I-130) be the preparer /translator for I-485

    If you filling for your parents (I-130), can you also be interpreter for their I-485 or you need independent 3 party person to do it if their English is not very good.
    What if they check the box part 10 1a, that they understand English but later decide to bring someone to their green card interview? is that possible?

    The issue here is that it's the discretion of the officer on whether they allow a family member to interpret. It's not against USCIS rules, but it is advised to officers that it's not ideal. The reason for this is conflict of interest. Perhaps your parents answer a question a certain way and you have to tell the officer what they said, but what they told you wasn't advisable to say, perhaps it doesn't look good. As a member of the family you may decide to change their answer to make it sound better - this is the conflict of interest they are concerned about.

    I'd advise not leaving it to chance and having perhaps a family friend do it instead or some not for profit organizations that might be able to provide someone.

      Ok that is what I was thinking too. I will go with someone else and see if the officer wants me or 3 party.

      My question is: If I as a petitioner of I-130 for my mom can I fill her I-485 document and sign Part 11 and Part 12 as interpreter/preparer?

        You for sure can fill out the preparer section if you prepared it for her, that's no problem. As for the interpreter section you can, but ideally have someone else declare themselves in that position, just to avoid possible (not certain) conflict of interest. As I say, it's officer discretion if they allow it, so I'd definitely avoid the possible delay in your application and have someone else do that.

          Also what must be typed in the box part 10 1b. I am thinking to put (Greek); and what about the box in 2 (?)?

            Yes Greek is fine if that's the language you used. And for 2 just put the person named in part 12, which is further down re the preparers details. So if you're preparing it, you put your name in box 2 in part 10 and then fill your details and sign in part 12.
