  • Adjustment of Status while on F1 OPT Stem

    Hello,
    I am on OPT Stem and already working. I just got married and I am ready to apply for adjustment of status. I already have EAD card valid for another two years. When I apply AOS, I am thinking to send all docs along with I-130. Will I get new EAD card and new social security card with no condition (my existing SSN card says employment with DHS authorization only).
    Secondly, just want to confirm if I am missing something in following packet:

    - I-130
    - I-131
    - G-325A (Petitioer)
    - G-325A (Beneficiary)
    - G-1145
    - I-485
    - I-765
    - I-864
    and other docs, e.g. passport copy, I-94, I-20, visa copy, SSN copy, EAD copy, marriage certificate

    Do I need to submit multiple G-1145 & G-325A for I-130 and I-485?
    Since I am on job and have paid taxes last year, do I still need to submit I-864 from my spouse?

    Hi, G-325a has been replaced by I-130a since April 2017 for marriage based applications. I-864 from your USC/GC holder spouse is mandatory regardless of their income level. If you want to use your income, mention that in the I-864 and provide supporting documents. (Some forums and sites also recommend including I-864a in addition to I-864 whether or not you have a kid.) Please research this site and the web extensively for what's expected in your situation.

    Not sure about applying for new EAD when you already have one that'll allow you to work for quite some time. Let some experienced members reply you on that one.

    Also make sure you add few more important documents to show bona-fide marriage. Co-mingling of finances, residence, trips together for visits, etc are considered the best ones. Then come interview time, you can take a whole stack of pictures, text messages, etc.

      You should send the following forms:

      I-130
      I-130A (Which replaces the need to send the G-325A. The I-130 has biographical info on the USC and the I-130A has the biographical info on the alien)
      I-485
      I-864 (As above said, you must send I-864 of the petitioner, i.e. your spouse whether or not they meet the requirement.)
      I-765 (You can apply for this under C9, but you can still use your current EAD to work until it expires. However note if you leave the US before you are approved a GC, when you re enter using your EAD that has the Advance Parole, you'd no longer be under the F1 status and you will then HAVE to switch your EAD to the one you got for your AOS petition.)
      I-131 (Since you're applying for this as well as the I-765, you would receive a combo card which is the EAD and Advance Parole)

      You can attach a G-1145 on the front page of your I-130 and one on the front page of your I-485. Since I-864, I-765 and I-131 can be submitted as part of the I-485 you don't need to put them on the front of those forms.

      Also read the instructions of the I-130 carefully to figure out the best bona-fide evidence to send along with it.

        Thank you guys. The other thing that I wanted ask about is Medical, should I submit it with my AOS packet or wait to submit? Also, can you please guide me what all involves in getting medical test, vaccination and drug test done?

          You can use this link to find doctors around you: https://my.uscis.gov/findadoctor . While scheduling an appointment with the doctor in my area I mentioned that this medical check is for I485/ GC Application and they knew the drill and I did not had to do mention anything else. They called me a couple of times and after the second visit gave me an enclosed/signed envelope for submitting to uscis. I submitted this along with my combined application and I think that is the suggested method.
          (Concurrent filing : I-485, I-131, I-765, I-130 based on marriage to USC)

            I submitted my initial medical with my first set of applications on July 18, 2017. I believe it was required in the I485 application. Since, I waited a year to get my interview date, I thought it necessary to re-do the medical. The interview will be on July 31, 2018. The total cost for both medicals is $335. I spent $150 for the renewed medical. In my opinion, based on all the stiff requirements and changes with the USCIS, and yes even as we watch our depleting bank account, I think you should send the medical with your initial package. This way it will be determined that you submitted ALL required documents in the initial application.

            So, you may call around for the very cheapest USCIS recommended civil surgeon in your area. Ask the doctor if he or she can make that medical visit for I485 act as an annual check-up and place it on your health insurance. Ask them for a copy of the test results and vaccinations. Keep those results, just in case you can return later (if it has passed a year for your interview date) to re-do medical at that same place or another, which by then you might no longer need any major vaccinations which are expensive.

            Also, my initial medical was beyond thorough. It was treated as an annual check-up. I received vaccinations, tuberculosis (TB) skin test, urine test and blood/urine tests for STI (Gonorrhea, syphilis, chlamydia) as standard requirements for the I693 medical. However, I also got blood and urine analysis for cholesterol, vitamins, protein, blood pressure, diabetes etc because it was an annual check up. In my second renewal medical, the visit was not treated as an annual check-up but as a plain immigration check up. It was done on July 9, 2018. I just gave urine sample, gave blood sample for testing for the same STIs that were done before and received the TB shot. The doctors filled out their own copy of the USCIS medical report, placed it in a sealed envelop, which should be only opened by the USCIS official and handed it to me.

              I personally waited until I received my interview notice, because it comes 4-6 weeks before your interview. So once I got that letter, I went the next day and had the medical done and 5 days later picked up the completed, signed and sealed form.

              That way I knew for sure I wasn't wasting any money and worrying that it would expire before the interview, because let's face it, some people are waiting way over a year for their interviews and therefore having to pay for a second medical.

              So my view, don't send it initially.

                I am applying for my AOS with AP and sending following documents, can someone please suggest if I'll have to pay the fee for i131A and how much is the fee for whole packet?
