  • Is K1 faster than other AOS?

Have a question for someone has K1 visa.

Do you think K1 AOS is faster than other people (F1, H1...)???

K1 is the immigration visa for the fiance and must get married in the 3 months after they entered USA.

    AOS married base

Actually not, when you going to fill up I-485 you will fall under category Married to USC. It doesn't matter for timeline what is the status K1, L1, H1... or no status at all. All AOS married to USC in one big line what is longer than work base AOS.
    Sorry.
Check online what is the time frame for you local immigration office. I hope it is not as long as TX!

I don't think so. A DACA user on here process took 4 months total, start to finish. Mine took 5.5 months and I adjusted from B2. Some cases are longer than others because of city and state or the IO. It just varies

K-1 may not be the fastest but it's the proper way to do things unless you're here already on F1, H1, L1, etc. Overstaying B1/B2 visas or even, adjusting before the I-94 expires isn't the way to do things.
K-1 does have a smoother AOS process. Up until recently, K-1 AOS interviews were waived. You still see some waived even though they were submitted after 04/17/17. They just get the green card in the mail.

From what I have read on vi$a journey, most k-1 AOS interviews are short. With the increased workload, officers are just making sure all documents are there and that it looks good. After all, those interviews used to be waived.

If I were to do it all over again and if weren't a same sex couple, I probably would have opted for the k-1 visa.

I don't know how it works if the person is in the US already. You would have to read the directions for that.

Here is something that I JUST learned. K-1 visa holders are authorized to work from the date of entry. They're supposed to apply for employment authorization. It's only valid for 90 days. Of course, you can imagine you'd never get that EAD approved before the 90 days to marry are up. Therefore, some time ago USCIS clarified that the I-94 issued to K-1 visa holders automatically allows them to work for 90 days. See for yourself. I don't know if there have been any updates since then, though.

If you are a U.S. citizen who wants to bring your foreign fiancé(e) to the United States in order to get married, you will need to file a

AILA Doc No. 15042032 Dated April 16, 2015 In order to obtain evidence of employment authorization, a fiancé(e) should file for employment Authorization with the USCIS Service Center having jurisdiction over their place of residence no more than 90 days after admission to the United States. If the applicant establishes that they qualify for the

Find k-1 on this SSA document. You will see that k-1s are in a Class of Admission that allows them to apply for SSN without EAD.
