  • Change Job after 3 months of becoming LPR

    Hi,

I've been working with my sponsoring employer since February 2017. My I-485 was filed in December 2017. My I-485 application was approved in May 2018.

After learning I obtained my GC, my former employer contacted me, and after some talks, they extended a job offer to come back and work for them. The position is in a similar capacity as what I'm doing right now (actually is almost the exact same title), however, it has better pay, better benefits and more importantly, a lot better work-life balance. Now, let me underline the fact that they came looking for me and not the other way around.

After considering their offer and discussing it with my family, I accepted the position and I'm scheduled to start working with them on July 30th, so almost at the 3-month mark of the approval of my I-485.

Now, I've been reading a lot about the recommended six-month period before changing employers, however, this is genuinely a very good opportunity for me professionally, and for my family in terms of work-life balance. After all of the above, could this create problems with USCIS at any point before or during my naturalization processs? Also, if questions arise during the naturilzation process regarding me leaving my sponsoring employer, are these good reasons to explain why I'm switching jobs after 3 months of becoming a LPR?

Again, my intention was never to leave my employer after a few months of becoming an LPR, it just so happens that a very good opportunity, both professionally and personally, arose and it was the best thing to do.

I appreciate your thoughts and recommendations/experiences.

    Thanks.

I haven't come across any USCIS offical statement which states leaving the sponsoring company after 6 months is acceptable and does not violate the LPR approval. I may be wrong as well. But it's more of a myth.

Having said that, as long as the new job aligns with the i140 job duties and you can explain the reason to quit the sponsoring company, that'd be a good start.

Talk to a lawyer, it should clear up your question

Thanks, Michael. Just to see if I understand correctly what you're saying, you're saying that the timing of my departure is not really relevant as long as my new position aligns with the approved I-140, is that correct?

I agree with you that there's no written rule about time that has to be spent with sponsoring employer after becoming an LPR, however, I've read in so many forums and threads that people, and lawyers, recommend staying at least for 6 months after being granted LPR. However, this seems to me like a "rule of thumb" and does not offer much explanation on why somebody like me would turn down a good professional opportunity elsewhere.

Anyways, I guess I'm nervous about the whole situation and wouldn't want to be in a difficult situation in the future.
