  • July 2017 Filers Orlando, FL

    Hello,

My husband and I filed for the following:
    I-485
    I-130
    I-131
    I-765

As of right now, He got his work permit back in October 2017 and he recently accepted a job, however, we haven't heard anything since September 1st on our I-485, that said, they were getting ready to schedule him for an interview. About a month ago, the status changed to "At this time USCIS cannot provide you with information for your case. Please contact the USCIS Contact Center at 1-800-375-5283 for additional information." We called and they don't have any information, we just have to wait.

What are the steps to take if as of today, we don't have a date for the interview and his work permit expires in October. Also, what about his drivers license? In Florida he needs to renew it annually and it will expire right about the same time as the work permit.

Any suggestions would be greatly appreciated.

    Hello,

I am in South Florida, Homestead area. Our timeline is below. We got the same online notices like you did. We called them when we saw the generic message, but decided to wait it out. In mid June we decided to apply for EAD renewal, a little less than the now required 120 days. There is no new fee we entered category C9 since we are adjusting status through marriage/immediate family. On the exact day we got the renewal acceptance notice, we also got the interview date. Both notices were dated June 22, 2018.

So go ahead and apply for the EAD renewal. It might prompt the interview date. EITHER ways you need to remain employed as in that case you will have access to more bonafide proof of relationship such as financial commingling etc. If you choose to renewal, follow their instructions carefully, use updated form and provide ALL required documents.

    All the best.

Thank you!! We called a couple days ago and asked about out status once again.. They put in an inquiry to see if we can get a follow up since the National Benefits Center is working on our case and it's been months ( close to a year) since we had the " Ready to schedule you for an interview.."

      Let's see what happens.

Thanks for responding. In my opinion go ahead and apply for EAD renewal so as long it's 3-4mths before the expiration date. You have nothing to lose, no fee to pay and it might prompt the issuance of visa interview.
