  • I-130 without I-485?

    Hi Everyone,

    I'm currently in the US, married to a citizen and wanting to adjust.

    I was just wondering the pros and cons of submitting the I-130 solo to being the process.

    I would post them all at the same time but this is the only one I can afford at the moment. Would you recommend doing this to get the process started, or saving up and put it all in together (may take a few more months to do this)

    I think it's better to save then send them altogether.

    Feb 19 2018:PD just I-130 I765 crooked lawyer did not file concurrently. My medical is sitting here + my IRS transcripts.
    Feb 23:RFIE (I130A) long story
    May 23: RFIE received.
    Aug 20: lawyer called to pick up bio paper. Shocked.
    Aug 8:PD I485 according to the form
    Aug21: Bio done walkin (scheduled gor Aug 27)
    Aug 22: RFIE mailed
    Aug 23:RFIE mailed
    8/27:RFIE received for I864&original birth certificate

      I would also recommend waiting to file concurrently. The thing is, if you file the I-130 on its own, you may have to wait many months for it to be processed. You can see the processing times on the USCIS website here: https://egov.uscis.gov/processing-times/

      If you wait a few months until you can afford to file concurrently, your wait time, although could still be a while, would most certainly be shorter, especially since you're married to a USC as opposed to an LPR.

      4-23: I-797 Receipts received
      4-27: Biometrics notice received
      5-10: Courtesy letter for I-693
      5-11: Biometrics completed
      6-04: Interview scheduled
      6-09: Received interview letter
      7-10: Interview complete & approved, status change to New Card being Produced
      7-13: Card was Mailed
      7-18: Green Card in Hand
