  • Concurrent I-130 and I-485 filed in Houston Texas

    My spouse is here on a B2 visa which expired July 19, 2018. We were married on May 18, 2018 and I have filed I-130 and I-485 on July 27, 2019. What will happen to his B2 Visa now that we are married and in the process of adjusting his status in U.S.

    Timeline starts today
    7/27/2019 - Concurrent Filing I-130 and I-485

        His B2 will be expired and he will be waiting AOS. Did you submit the 765 and 131 as well so he can have work and travel authorization? Don't send the medicals wait until you have an interview scheduled.

        Feb 2017 - Date received
        Feb 2017 - RFE received
        March 2017 - Biometrics completed
        April 2017 - RFE response received case no longer on hold
        April 2017 - Case is being scheduled for interview
        May 2017 - AP/EAD received:
        March 2018 - AP/EAD forms sent for renewal
        Sept 2018 - AOS interview scheduled.
        Oct 2018 - AOS interview
        Nov 2018 - Green card in hand

            Sounds like you've everything needed now its just the waiting game.

              Yes I filed all of those along with the 864. So he will not be able to use his VISA ever again?

                When his travel visa is expired its expired. It will automatically roll him into an overstay category HOWEVER since he is adjusting status it will not impact him in a negative way he will just not have any status because he is in process. When he gets his travel card he can go places.

                  Thank you....so yes we will be waiting on the okay for him to travel which they say takes about 3-6 months. Hopefully sooner

                    8/7/2018 - Received everything back due to using an outdated I-485 form. Now I have to start over.

                      Received 4 text messages last night and 5 emails. Applications have been accepted and I should receive the I-797 by September 9, 2018.
