    Hello everyone,

    I apologize if i posted this in a wrong thread (if so please move to the correct one), and also if i give insufficient info. I need some help with documents i am able to attain while being on approved asylum, waiting for my green card application to process and get approved.

    We have been granted asylum a little over a year ago, got our work permit, unrestricted SSN, and judges letter of approval. After a year we applied for the green card, and its been 13 months since (Dalas center). They just sent us that our medical is expired and we need to do it again (as this is our fault for them not looking at the application for so long, but who would care if we can pay for all this all over again), and this will prolong my wait time more.

    I have just moved to TX from NJ, and i am in a bit of a problem getting the DL. My work permit expired, as i have not needed a replacement as i work without issues with my SSN and no restrictions, and cant afford to apply for another one for me and my wife (on top of 3-6m wait time). Its just simply too many immigration fees i have paid, and have to pay for new medical exams. My NJ license expires in a little over a week, and i have been to TX DPS (which is where you swap your license if you are out of state), and basically, as i expected was brushed off. I dont have an I-94, or I-797, or any other document other than the letter from the Judge approving our asylum. I have been to USCIS offices, and called them multiple times, trying to get any kind of document that can help me to go through getting the identification in local government office, and was always told other than what i have (letter) i cant get anything else.

    I am forced now to apply for another work permit, my license will expire and will have to do tests again, and possibly loose my job because i will not have a valid license.

    Is there anything i can do do obtain any other document such as I-94, I797, or anything that i can use in local DMV/MVC offices. They refuse to look at my letter from the judge, even though it has all the information they need to do my electronic verification of status.

    According to this Texas web page, for US citizens, permanent residents, refugees, and asylees, "Documents may be expired unless otherwise noted", and one of the documents is an "I-766 with category A5 or A05". So you should be able to use your expired A05 (asylee) EAD.

      i do have my EAD which was valid for 2y (i guess thats cat A05?) and i gave it to them. they refused it because its expired. now here is the thing. on that website (which is their website) it does say (Documents may be expired unless otherwise noted.) for lawful presence requirement. But in this brochure https://www.dps.texas.gov/internetforms/Forms/DL-57.pdf under section Primary ID documents it is noted for ID-ing I-766 has to be unexpired. they havent used my work permit to ID me, i have my passport and a valid ID. but supervisor took her power into play here, and did not want any expired documents, even EAD is only for lawful presence and has my letter as a supporting document. basically i had to deal with an ***, and am wondering what now. is there any way to get another document that i can use before i make another trip and wait another 6h in that God forsaken place

        I live in TX, too. DPS is here very difficult to deal with. They do their best not to give DL to immigrants and extremely rude. I don't know how but supervisors have extreme power. In my case, She didn't accept my valid passport as a form of ID! This is what she came up with to deny my application! I have a feeling that it is DPS's policy not to extend or issue DL to the people who is AOS process. I am afraid you will have to renew your EAD or get an info pass to see if they can provide you a letter.

          Ok, let's start with the basics here. There is no need for you to be going through any of this. You need to inform yourself and learn everything about your status. You were granted asylum. Your EAD gets an automatic extension for 180 days if you file a renewal application within 180 days of its expiration. In regards to the fee, I believe you would have qualified for a fee waiver.

          Does your I-94 show ?Sec. 208 Asylee? or ?Sec. 207 Refugee??

          Next time you go there, you need to print the requirements and show them to the supervisor. Try a different DMV location. Make sure you remain calm and are respectful. Record the conversation if you have a phone. Let the officer know you will be recording the interaction to ensure you are treated fairly.

          Make an infopass appointment and see what they can do. maybe the officer could call the DMV and ask for a supervisor?

              Yup. Thats correct. I dont have anything than the judges letter. I cant even schedule an app in USCIS field office here in Houston, as they never have apps. Thinking of just going there. Thing is, they weren't much help in NJ as each time we went there we got an answer we cant get any additional documents.

              As far as renewal of the EAD, it expired in May so its still within those 180 days. I was under the impression that i cant renew it now, and have to apply for a new one. Since i am on an active and pending GC application, i am told i can apply for EAD again for free since it has nothing to do with my EAD that i got while waiting for my asylum to be approved.

              On the other hand, i did go to another DPS, and printed out the website where it says that doc can be expired unless otherwise noted. Dealt with a very nice guy, he didnt even bother to call for a supervisor, put everything in the system, and i am waiting for my SAVE verification, as this is how they have to verify my legal status. He used my expired EAD though, and didnt even ask a question. I just hope this SAVE thing goes through, as i have heard these verification fail a few times before even though a person is legal.

                Just FYI, if you try to get an appointment around midnight, I think I tried around 12am, there are plenty of appointments for the next 2 wks. I didn't get one as I got my EAD approval. I hope SAVE works out. You are so lucky to find such a nice DPS employee. Do you mind if I ask which DPS was it? I will have a trip to DPS next week, I really don't want to deal with the one I went before. It was the largest one in town, don't remember the location.

                  Thanks for the tip on the field office. i will try that. DPS was in Rosenberg. I live in Katy so its not far for me to go there. Not sure where you are located. Problem i had originally was in Houston north, which is the one i believe you are Referring to. its the biggest one in the city. Ive heard they are OK in Spring office also, but Rosenberg is going away from the city, and avoiding traffic. Just FYI, if u show up very early, before opening, dont be scared of the long line. As soon as you get in and get a number, it moves much much faster. Hope it turns out well with SAVE, and will most likely apply for new EAD until my GC gets processed, just to have it. Apparently no fee is needed since this is a new adjustment of status application.

                    Yes, I had problem at Houston North and the supervisor was a lady... I am closer to Houston North, Katy is Rosenberg is around 40 mins away but next time I will go to Rosenberg. I do not want to deal with Houston North again. Thank you so much for the info!
