  • Seeking clarity on priority date

    Hi all,

I have a question with regards to priority date.

On April 11, 2017 my labor application was submitted so my priority date is the same on my 1-140 approval notice.

On June 14th, 2018 my I-485 was received by USCIS and subsequently I received my biometrics appointment and completed it by early walk-in. At present biometric review has completed 3 weeks back and waiting for the next update.

So my question is what does priority date signifies? What I mean to ask is once this case is forwarded to the regional USCIS processing center where I am located, will they give me higher priority or let?s say to an applicant who has a priority date March 15, 2018? Or is it just random case pick?

    Will highly appreciate your feedback.

Priority date is only to determine when a visa is available for your country of birth. When your priority date becomes current you can submit your I485 form. Priority date job ends once you submit your I485 and USCIS accepts it. After that USCIS processes cases in the order they received the I485 . That is based on I485 received date. Priority date doesn't matter anymore.

Also a visa number must be available for the priority date in order for the I-485 to be approved. So if it retrogresses, it's possible they will have to hold the I-485 as pending until a visa number is available again before they can approve it.
