Hi,
I'm currently on a blanket L-1 which has itself expired, but underlying I-797 expires on January 1st, 2019 (I-94 is valid till 2020 though). My employer has filed I-140 for me in early May, and has concurrently filed I-485, I-765 and I-131 on 5th of July.
Since my status expires on Jan 1st, I'm advised by my employer to go to another country to lodge an L-1 extension at an US Consulate some time in mid-to-late December, but, given the timeline for I-131 processing, I might or might not get the AP by then. If I exit the country before I receive the AP, does it mean the USCIS will consider my petition abandoned even if I just have to file an extension for my current status? If so, then what part - just I-485, or I-140 as well? And in any event, what course of actions can you recommend?
So many moving parts in my case, I hope I've chose the right subforum.
Many many thanks.
