  • Why only i-130 approved ?

    Hi everyone. Applied for GC in september 2017. And had interview finally this past tuesday. Yesterday I had notification for i-130 and it says approved but nothing has been changed for i-485. Also at the end of interview I asked te officer if it is approved and she said not yet. Does anyone know whats going on? i know it has been 3 days only and waiting will help it. But I would like to know if anyone know anything ir any ideas other than recommending to wait. Thanks a lt good luck for everyone

    Your timeline? Field office? It helps others who want to help you. We shouldn't have to dig for all that info from your previous posts.

      Websites take awhile to be updated

      It seems there is a delayed update on either websites USCIS and DHS account. A few hours after my I485 interview I got update about card produced on USCIS, then statement of approval on DHS. Three days later I got I130 was approved on DHS. Card mailed on USCIS. Essentially, give it some time, a day or couple days to reflect the respective updates.

        I had the exact same sequence as you.
        Marriage AOS - 2018

        4-10: Sent to Chicago Lockbox
        4-12: Arrived in Chicago
        4-14: Picked up by USCIS
        4-19: Email & text notifications received
        4-23: I-797 Receipts received
        4-27: Biometrics notice received
        5-10: Courtesy letter for I-693
        5-11: Biometrics completed
        6-04: Interview scheduled
        6-09: Received interview letter
        7-10: Interview complete & approved, status change to New Card being Produced
        7-13: Card was Mailed
        7-18: Green Card in Hand

          Timeline is;
          applied aos on sep 29
          Recieved fingerprint 30 days later and recieved ead 60 days after application. Had interview on tuesday. Office is charleston sc.

            It's hard to say why ISOs update their work the way they do. To me, it sounds like the ISO is letting you know that your I-130 is all good. USCIS does not doubt your evidence of bona fide marriage, and now the ISO is focusing on reviewing your admissibility. I'd say hang in there. The Charleston, SC is also pretty fast. They may interview as many people as they can one week, and then adjudicate those cases the following week.

              Is there any chance to hold i485? Or deny ? What would be the next step in that case if they hold

                I clicked on your previous posts (which I really need to stop doing). Did not see any reason why you would be inadmissible. Did you fulfill the J-1 requirement to return to your country? Did you get a waiver?

                  Do you mean 2 years rule? I did not fulfill anything while I was coming here. I stayed without visa for 2,5 years.

                    Come again? You gotta explain this one to us. To be clear you entered the USA under a J1? The I-94 you sent with your application was under J-1? But you wrote overstay in the i485 paperwork?

                    Also if you have never departed the USA. Switched from J1 to B2, no way your J1 was subject to 212e. So its just an overstay that will be waived as married to USC, so just be patient let USCIS do their job. If you were subject to 212e hmm things sure take a much tougher turn cause if you didnt depart and re-enter with a B2 USCIS has put in a worse spot since they never should have allowed that.

                      I did not have 2 year rule I am sure. I switched from j1 to b2 and extended b2 another time. Today I got only 130 approval notification in mail. They usually come with 485 approval notice.

                        Like Cali2018, don't poke the bear. Let them do their job. I am always advocating being proactive but in your case, I would just let the ISO his/her job. For all we know, maybe the approval is already entered but the system has not updated. There is a Tools Outage scheduled for tomorrow between 5am and 6pm.

                        The worst that could happen aside from what cali2018 mentioned is that they deny it, and in that case, you probably would still have the option of consular processing. Since your I-130 is already approved, it would be faster. But let's not get ahead of ourselves. Your switching from J1 to B2 and then overstaying and adjusting is probably a first for the ISO who interviewed you. They have to justify their decisions, and I imagine he/she would want to run it by Senior Officers.

                        Hang in there.

                          I am from Turkey. This waiting is killing me and I cant do anything. I even didnt get a AP. I was planning to travel. It has been more than 5 years

                            only i-130 approved so far

                            same boat here interview was july 25 officer give us a paper at the end . you completed interview. case being held for review. after no dhs or uscis web change. recive letter on mail august 1 i130 approved. on same day letter was recived dhs case changed to approved and in the letter say it was approved on the july 26 . still waiting for my i485 decision. interview was a bit strong when start but then officer was so nice while him was asking stuff from the applications interview took around 45 mins never was separated .. the wait is killing me hope to get goods news this week also my medical stuff is expiring soon tracking still showing interview was schuduled
