  • What are his chances ?

I have this friend in Texas who?s been in the States for 10 years. His green card expired March last year and did not renew it or remove conditions before it expired and his USC wife divorced him.

He?s in an immigration prison in Texas for wire fraud. What are his chances on getting his green card renewed and can he be released when he leaves prison ending of the year? He?s planning on getting married from prison before he leaves prison is that even possible? Can he still remain in the States after he?s released?

    His Chances are slim

He can file Removal of Conditions (I-751) by himself on the basis of divorce. The Removal of Conditions is not itself affected by crimes, but the crime (which he will need to disclose on the I-751), if it is a deportable offense, could lead them to start deportations proceedings against him if they haven't already done so.

I'm not sure what you mean by "immigration prison"; there is only immigration detention for people awaiting a deportation hearing. If he has been sentenced for a crime or has a pending criminal trial, that is in regular prison.

This is my personal opinion and is not to be construed as legal advice.
