  • EAD Card Expiration & I-485/I-765 Status

    Hi,

My current EAD card is set to expire on December 17, 2019. This card has been issued to me based on STEM OPT extension. I am currently working. My employer last year filed for my labor which got approved and subsequently I-140 also got approved.

Since July 11, 2018 my I-485/I-765 online status states ?We reviewed your biometrics and still processing your case.?.

My questions are based on a hypothetical scenario. If 11 months from now in May 2019 my interview for status change still has not been scheduled:-

Q1. Will it be possible for me to submit an expedite I-765 request for EAD card?
Q2. Will I need to do medical test again before submitting expedite request as my current medical was done in April 2018?
Q3. How many months will it take to fulfill expedite I-765 request?
Q4. How much does this request submission cost?
Q5. What is the duration of validity for this card? E.g., 3 months, 6 months etc.
Q6. How many times can I renew it?
Q7. What will happen to my current STEM OPT EAD card once the new one gets generated based on my I-485/I-765 application?

I am thinking ahead to avoid any complications in December 2019 and plan accordingly. I really hope and pray that well before May 2019 my interview will be scheduled and I will get through it successfully.

Hope to receive useful advice as always. Also hope you all get through this difficult stressful phase of your life.

The EAD might take 5-6 months. You will get it before 11 months. It will be valid for 1 year. You can renew it for free for an unlimited number of times as long as your I-485 is still pending. Nothing will happen to your current EAD card. You can continue on OPT and not use the AOS EAD if you wish.

This is my personal opinion and is not to be construed as legal advice.

Thank you for your feedback. 5-6 months is a long time to process expedited EAD card request. But it?s good to know this because now I will apply for it sooner in 2019 then wait till May.

I was talking about the regular processing time. I don't see any reason that would qualify you for expediting EAD, and you don't need it expedited anyway.
