  • Possible to Get Interview before EAD?

    So my husband did his biometrics on 7/27/18. We had a little snafu with the i765 and a returned NOA1 that put the case on hold for a bit. However, our priority is technically 8/21/17 because that?s the day we filed our i130. Because we have that priority date does it put us on top of the pile so to speak?

    I?m wondering if we could get a notice for his interview soon? A lot of the cases around ours have had there?s scheduled. It seems USCIS has totally given up on updating their case statuses. Once we sent in our corrected i765 we got the biometrics appointment really soon after.

    Our i485 status still says our NOA1 was sent back by the Post Office for almost three months now even though they?ve reissued us a new one and we recieved it ages ago.
    Marriage Based AOS

    08/21/17: Priority date

    3/16/18: I-130 Approved
    4/07/18: I-485, I-864, I-765, I-693, and G-325a sent out
    4/27/18: Check cashed
    4/30/18: Rejection notice for I-765 (incorrect filing fee, no signature)
    6/07/18: Notice was returned because Post Office was unable to deliver, request for reissue sent
    6/25/18: Reissued NOA1 received
    6/27/18: Corrected I-765 sent out
    7/10/18: New I-765 NOA1 recieved
    7/13/18: Biometric letter recieved
    7/27/18: Biometrics done

Don't put any hopes on the infopass appointment. However, that's just a formality so that you can tell your Senator that you have tried to resolve this on your own. Present the approved I-130 etc, and ask them to help you get scheduled for an interview. Gently ask them to contact the Field Office and ask the field office to request your file. Otherwise, the response you will get will be from the congressional unit at the NBC letting you know that the file is still at the NBC.

          There is no Infopass in Orlando unfortunately. I guess I?ll just have to wait.

            Infopass appointments are made available right at midnight. Sometimes the slots open at 11pm.
            If there aren't any, then just go straight to your senator. You have an approved I-130.

              I didn't file them together though. Visa Journeys timeline predictor says my EAD will probably be adjudicated between November 22 2018 - December 5 2018. It just seems insane that I sent my i485 out April 7 2018 and I won't even get the schedule notice until sometime in December. That's why I wonder if they'll just skip over the EAD and send me the interview notice, if they don't that would mean getting your green card is faster if you don't file an i765.

                    Truly you filed the paperwork all over the place. A g-325a form is no longer needed only had to do a i-130A when you did your i-130. Your case looks similar to someone moving from CR to AOS in USCIS mind is my guess. Which means your actual PD will be April 2018, I am pretty sure this is what the infopass will tell you. They are going to assume your husband is a AOS case and drive from his i485 PD.

                    Actually your PD could even like June 2018, whats received date for i485 NOA1?

                      I just followed what the USCIS website said. The i485 NOA1 says the priority date is August 21, 2017. He is an AOS case.

                        What is the received date though? As a USC you could have filed everything together. They are truly ignoring PD for USC now and saying its your “received date” as the inquiry date since they are so backed up. Same with i765 and i131.

                            It's only way they can handle the backlog...and their goto excuse when they don't know the status of your case. That said people are getting RFEs for taxes 5-7 months after filing so I could see the beef with using PD date like they did in the past back when timelines were normal.
