    Hello Guys,

    I just got RFE for 485 - Regarding 867. My SO didn't qualify enough in the income requirement and we decided to use a joint sponsor. My question is the 2017 IRS transcript good enough or do i need also to supply the W-2, 1099, etc to support it? I read i don't need to send it if im doing the IRS transcript in the 867 instruction but in the RFE it does?. Just need clarification. So far i have everything the RFE is asking for.

    When I got the RFE regarding my i-864, they asked for joint sponsor's latest Tax Returns, W-2 and 1099s, and also proof of citizenship. I submitted all they asked for. They could deny you if you submit insufficient documents after RFE

      Just IRS transcripts should be fine. Somewhere in the forms they mention that tax transcripts are preferred and if that is what you submit, then W-2, 1099s, etc. are not needed.

        My RFE asked for my joint sponsor's 2017 tax returns. I submitted: 2017 IRS Transcript, W-2, and payslips. I had to include the W-2 and payslips because my joint sponsor files her taxes as 'married filing jointly', so I had to show her individual income, separate from her spouse (whose income we didn't use). It says on the I-864 instructions, "If you provide a photocopy of your Federal individual income tax returns, you must include a copy of each and every Form W-2 and Form 1099 that relates to your returns. Do not include copies of these forms if you provide an IRS transcript of your Federal individual income tax returns rather than a photocopy unless you filed a joint income tax return with your spouse and are qualifying using only your income". That instruction truly confused me at first. I was ready to submit just the IRS Transcript, but after reading and re-reading the instruction, I got back to my joint sponsor and asked for her own W-2 and payslips. I thought, "what if a newbie NBC staff gets hold of my RFE response and is confused as well", so I decided to explain what my submissions are about, as shown below.

        To be safe, ask your joint sponsor how s/he is filing her yearly ITR; if it's 'Married Filing Jointly', then you need to include with the IRS transcript his/her W-2 and payslips, too. At least, that's how I understood the instructions.

          There is a little more to it than that. The wording is terrible, though.
