  • Not related to GC - Getting CDL from another state

Hello so my father is along time truck driver. His CDL expired and he decided to go to this person that got him a CDL but from a different state. Now he is worried about getting his regular DL from the state he lives in?

I am getting a little worried since I will be applying to sponsor them in a little over 2.5 years. His CDL expires in 5 years and the way it was done was that his SS card stated Not Authorized to Work (or something like that) and somehow they removed that which allowed him to get his CDL from another state.

I know this is not related but if someone knows anything about this, please let me know.

I know this might be illegal but my dad is a good person and his passion is being a truck driver. He has been doing that all of his life.

Your father has committed fraud/forgery by presenting a forged instrument( altered SS card) to a government agency (DMV/MVD). It can/could come back to bite him later when you sponsor him. There are states out there that do not care about immigration status when issuing drivers licenses. Why not move there instead of commuting fraud?

By the way these are public forums and I think you should be more careful of what you share here. ICE/USCIS also have access to these forums.

Your father is a good person but remember that moral character is one of the things USCIS takes seriously, hence, YES and NO questions on i485 forms. Because this was done to get a State issued ID, chances are, the federal government will soon find this out when they do background checks. Unfortunately, I don't think your father will be able to stay in the US if USCIS/ICE gets a hold on his case or driver's license number.

However, someone on here had posted that their wife was able to acquire a well paying job when they took out the inscription, "Valid for Work Only With DHS Authorization" from an old SS card(she was out of status and got the job by using her "non-restricted SSN & Driver's License) photoshopped. She was still able to get her status adjusted because the company she worked with had that information (photo copy of her SS CARD). In your case, it's the DMV, a government agency, that has your father's SS CARD copy, so with that I don't know if he will be successful in getting another DL.
