I know someone who entered the United States under a V-2 visa for 2 years expiring on February 2019. Her father was a beneficiary under the LIFE Act (Immigrant Petition for Alien Worker). However, her father's application to adjust status (I-485) was denied on August 3, 2018. They don't plan to file an appeal or review.
The questions are:
1. Is she now out of status now that her father's I-485 is denied.
2. Is she still staying legally in the United States since her V-2 visa will expire only on February 2019.
3. What if she marries a legal permanent resident, will she be able to apply for a green card?
Thank you,
