  • What do I do next?

    We filed in July 2017. Had our interview in July 2018. My wife's medical exam was 366 days before the interview, so they made her take another (their fault for taking so long to schedule the interview), along with requesting proof she had paid speeding tickets in other states! Ridiculous but whatever. We did that and sent it all off. Now we have heard absolutely nothing. My wife's work visa now expires October 10. She is a doctor with good income which we need so it is freaking us out. What do I do next? Schedule a meeting with immigration? Send a request to expedite (I've done that before and it did nothing)?

    I'm in ATL too! They should make a decision within 2-3 months after the interview once they receive your wife's medical and stuff. As long as you submitted what they asked for I wouldn't worry about it too much.

    Why would they care about speeding tickets? that is weird to me, did the immigration officer ask about traffic violation stuff?

      I'm in ATL too. Did u guys file for i765? Make an Infopass appointment and let them know it will cause huge financial loss and distress to your family if she doesn't get her card soon.

        Did you apply for a work permit when you filed AOS? If not you need to apply for it NOW and request it gets expedited - (on grounds of job interruption and severe financial loss) after you receive receipt notice.

          When you say 'work visa', do you mean the EAD? I assume (sorry if you said it elsewhere, I didn't look at your other posts) that it's a marriage-based AOS?

          If it expires in October, she should file for renewal and she'll get an automatic extension of 180 days. See: https://www.uscis.gov/i-9-central/42...-circumstances

          "eligibility categories codes for a 180-day automatic extension are A03, A05, A07, A08, A10, C08, C09, C10, C16, C20, C22, C24, C31 and A12 or C19"

          "The employee?s expired EAD in combination with the Form I-797C Notice of Action showing that the EAD renewal application was timely filed and showing the same qualifying eligibility category as that on the expired EAD is an acceptable document for Form I-9. This document combination is considered an unexpired Employment Authorization Document (Form I-766) under List A."

          If she did not apply because she has some other work authorization, she should definitely apply immediately and with a request to expedite.

          Also, as for the caring about speeding tickets in other states, immigration is national, not state-based. So even though you have a local field office, it doesn't mean that they only care about things that have happened in that state.
          It's stupid to care about traffic violations, esp since I don't think anyone knows someone who hasn't violated at least one traffic law... but it is what it is. They mainly want to know that you don't have any outstanding payments or issues to worry about.
