  • Urgent! AOS denied after rescheduling enterview

    Hello All,
    Here is my situation:
    My AOS interview (employment based) was scheduled for the 29th of August. But due to previously planned business travel, my attorney sent a letter to USCIS to reschedule my interview until late september. To my surprise, on the same day of interview I got an update that my I-485 has been denied because of no show and no request for reschedule. I booked an infopass and took the evidence that letter to reschedule was received by the interviewing office on the 20th of August (letter to reschedule + proof of delivery from fedex). Officer looked at my case and said that they will probably reopen the case since it was an error on their end. She said to give it a couple of weeks to get an answer but I am nervous that I won't get an answer on time before I can apply for an appeal (has to be within 30 days of denial notice)

    Has anyone had a similar experience? if so please share your timeline.

      You're overthinking it. If your attorney contacted them to reschedule it then you will be fine. Just wait for the new date and contact your attorney to see whether they've heard anything or not.

      Feb 2017 - Date received
      Feb 2017 - RFE received
      March 2017 - Biometrics completed
      April 2017 - RFE response received case no longer on hold
      April 2017 - Case is being scheduled for interview
      May 2017 - AP/EAD received:
      March 2018 - AP/EAD forms sent for renewal
      Sept 2018 - AOS interview scheduled.
      Oct 2018 - AOS interview
      Nov 2018 - Green card in hand

        I hope all will turn well at the end. I just want to know if someone went through the same thing and what was the timeline just to know if they will reopen the case or not.

              Reach out to your senator and have the office inquire. The minute a senator gets involved, everyone starts following the book and behaving in a professional manner. It was their error - so TECHNICALLY since it's a USCIS error, now you fit the expedite criteria. SOOOOO request an expedite through your Senator too.
