Marriage visa in process, received RFE for H1b transfer
Hello,
I have an H1b visa valid until 12/2020. The visa is under my previous employer. I switched jobs to a new employer in April 2018, and filed for an H1b transfer without premium processing.
I got married to a US citizen in July 2018, and submitted documents for adjustment of status and work permit in early August 2018.
I received an RFE for my H1b transfer in July 2018 and my new employer has until Oct 1 to respond.
What happens if my H1b transfer is denied before I receive documentation/approval for the marriage-based visa?
Does the marriage visa supersede the H1b transfer? If my H1b is denied, can I continue to work for my employer until the marriage change of status is approved? Does my employer have to respond?
What is the process now for my marriage visa? Is there a likelihood of denial?
This situation is confusing me thoroughly so I could use any experience snippets any of you may have. THANK YOU!
